Anita Neville: With regard to criminal law amendments contained in legislation introduced in the 40th Parliament, Third Session, namely Bill C-4, An Act to amend the Youth Criminal Justice Act and to make consequential and related amendments to other Acts, Bill C-16, An Act to amend the Criminal Code, Bill C-17, An Act to amend the Criminal Code (investigative hearing and recognizance with conditions), Bill C-21, An Act to amend the Criminal Code (sentencing for fraud), Bill C-23A, An Act to amend the Criminal Records Act, Bill C-23B, An Act to amend the Criminal Records Act and to make consequential amendments to other Acts, Bill C-30, An Act to amend the Criminal Code, Bill C-39, An Act to amend the Corrections and Conditional Release Act and to make consequential amendments to other Acts, Bill C-48, An Act to amend the Criminal Code and to make consequential amendments to the National Defence Act, Bill S-6, An Act to amend the Criminal Code and another Act, and Bill S-10, An Act to amend the Controlled Drugs and Substances Act and to make related and consequential amendments to other Acts: (a) was a gender-based analysis of the impacts of the proposed amendments undertaken before the legislation was introduced in Parliament; (b) if yes to question (a), (i) when was this analysis conducted, (ii) by whom was the analysis conducted, (iii) which indicators were used to determine the gender-based impact of the legislation, (iv) what was the conclusion of the analysis regarding the gender-based impacts of the proposed amendment; (c) if no to question (a), (i) does the government intend to undertake a gender-based analysis of the amendments, (ii) when will this analysis take place; and (d) did the Treasury Board Secretariat require that a gender-based analysis of the legislation be completed before the bill was introduced in Parliament?

Parliament continues to share the Commission's views on this matter, as can be seen from the recommendation on criminal sanctions and Community law (B5-0707/2001) which it adopted on 15 November 2001, in which it called on the Council to refrain from taking any action on environmental criminal law before the draft directive on the protection of the environment through criminal law was adopted. Parliament considers nonetheless that it should give its opinion on this proposal for a framework decision, both because the pillar-based distinction is due to disappear and because the framework decision complements the aforementioned Directive 2003/ /EC, which, in turn, is consistent with the proposal for a directive adopted by the Commission on 13 March 2001.

Therefore the Council should refrain from taking any action on environmental criminal law before the above-mentioned draft Directive on the protection of the environment through criminal law is adopted.

(7a) The European Parliament shares the views expressed by the Commission, as is apparent from its recommendation of 15 November 2001 on criminal sanctions and Community law( 1 ), in which it asked the Council not to take any action on environmental criminal law before the adoption of Directive ./.EC [on the protection of the environment through criminal law]; it considers, nonetheless, that it should give its opinion on this new framework decision so that the Council may take it duly into account.

Parliament appears to agree wholeheartedly with the Commission's viewpoint. At the sitting of 15 November 2001, it adopted under the procedure without debate a recommendation on criminal sanctions and Community law (B5-0707/2001) and, in paragraph 6 thereof, called on the Council to 'refrain from taking any action on environmental criminal law before the [...] draft Directive on the protection of the environment through criminal law is adopted'.

In its recommendation on criminal sanctions and Community law of 15 November 2001 the European Parliament recommended that Council refrain from taking any action on environmental criminal law before the draft Directive on the protection of the environment through criminal law is adopted.
