The Treaty amending the EU and EC Treaties, which was signed in December 2007, changed certain provisions of the Euratom Treaty via its "Protocol No 12 amending the Treaty establishing the European Atomic Energy Community".
Le traité modifiant les traités UE et CE, signé en décembre 2007, change certaines dispositions du traité Euratom via son «protocole (n° 12) modifiant le traité instituant la Communauté européenne de l'énergie atomique».

Although the Euratom Treaty gives the Community no strict, exclusive powers in certain fields, it retains real added value for its members: on the basis of this Treaty, the Commission has adopted recommendations and decisions which, although not binding, set European standards.

However, it is, nevertheless, worth noting that the entry into force of the Lisbon Treaty brought some changes to the relationship between the Euratom Treaty and the Treaties of the Union, notably the abrogation of Article 305 of the EC Treaty, according to which the EC treaty was to be "without prejudice" to the Euratom Treaty and the introduction of Article 106(a) in the Euratom Treaty, which states that the Union Treaties "may not derogate " from the Euratom Treaty, while listing a number of articles of the TEU and TFEU which apply to the EA Treaty.

Notes that expectations with regard to nuclear energy, to which the Euratom Treaty gave expression five decades ago, have changed; notes that those expectations now relate more to the need to have, in the form of the Euratom Treaty, a sound legal framework to govern the supervision of the use of nuclear energy in the European Union and to provide a framework for the integration into the European Union of countries which use nuclear power, through the transposition of the Euratom acquis communautaire; acknowledges that significant chapters in Title II of the Euratom Treaty have made it possible to protect the public, workers and the environment against ionising radiation (Chapter III), to develop research in the areas of waste management and plant safety (Chapter I) and to implement safeguards in respect of fissile materials in Europe (Chapter VII);

(10) In accordance with Article 277, first paragraph, of the EC Treaty and Article 181, first paragraph, of the Euratom Treaty the unit of account in which the budget is drawn up, and which is also used for purposes of implementation and for presentation of the accounts, should be determined.
