TRADUCTIONS EN CONTEXTE

In relation to the financial corrections imposed by the contested Commission implementing decision of 2 May 2013 on excluding from European Union financing certain expenditure incurred by the Member States under the Guarantee Section of the European Agricultural Guidance and Guarantee Fund (EAGGF), the European Agricultural Guarantee Fund (EAGF) and the European Agricultural Fund for Rural Development (EAFRD), notified under document C(2013) 2436 and published at OJ 2013 L 123, in so far as that decision imposes on the Hellenic Republic a financial correction totalling EUR 6 175 094,49 for expenditure incurred by it within the framework of the European Agricultural Fund for Rural Development, in Axis 2, 2007-13, area related measures in the financial years 2009 and 2010 (claim years 2008 and 2009), the Hellenic Republic puts forward the following pleas for annulment:
Concernant les corrections financières prévues par la décision d’exécution de la Commission du 2 mai 2013 écartant du financement de l’Union européenne certaines dépenses effectuées par les États membres au titre du Fonds européen d’orientation et de garantie agricole (FEOGA), section «Garantie», du Fonds européen agricole européen de garantie (FEAGA) et du Fonds européen agricole pour le développement rural (Feader), notifiée sous le no C(2013) 2436 et publiée au JO L 123/2013, dans la mesure où celle-ci impose à la République hellénique une correction financière d’un montant total de 6 175 094,49 euros pour les dépenses effectuées par la République hellénique dans le cadre du Fonds européen agricole pour le développement rural, Axe 2, 2007-2013, mesures liées à la surface, exercices 2009 et 2010 (années de demande 2008 et 2009), la République hellénique fait valoir les moyens d’annulation suivants:

Pursuant to Article 9(1)(a) of Council Regulation (EC) No 1290/2005 of 21 June 2005 on the financing of the common agricultural policy (2), Member States, within the framework of the common agricultural policy, are to adopt all legislative, regulatory and administrative provisions and take any other measures necessary to ensure effective protection of the financial interests of the Community, and particularly in order to check the genuineness and compliance of operations financed by the European Agricultural Guarantee Fund and the European Agricultural Fund for Rural Development, to prevent and pursue irregularities, and to recover sums lost as a result of irregularities or negligence.
Conformément aux dispositions de l’article 9, paragraphe 1, point a), du règlement (CE) no 1290/2005 du Conseil du 21 juin 2005 relatif au financement de la politique agricole commune (2), les États membres doivent prendre, dans le cadre de la politique agricole commune, toutes les dispositions législatives, réglementaires et administratives, ainsi que toute autre mesure nécessaire pour assurer une protection efficace des intérêts financiers de la Communauté, et en particulier pour s’assurer de la réalité et de la régularité des opérations financées par le Fonds européen agricole de garantie et par le Fonds européen agricole de développement rural, pour prévenir et poursuivre les irrégularités et pour récupérer les sommes perdues à la suite d’irrégularités ou de négligences.

Under Article 9 of Council Regulation (EC) No 1290/2005 of 21 June 2005 on the financing of the common agricultural policy (4), the Member States are to take the measures necessary to ensure effective protection of the financial interests of the Community, and particularly in order to check the genuineness and compliance of operations financed by the European Agricultural Guarantee Fund (EAGF) and by the European Agricultural Fund for Rural Development (EAFRD), to prevent and pursue irregularities and to recover sums lost as a result of irregularities or negligence.
Aux termes de l’article 9 du règlement (CE) no 1290/2005 du Conseil du 21 juin 2005 relatif au financement de la politique agricole commune (4), les États membres doivent prendre les mesures nécessaires pour assurer une protection efficace des intérêts financiers de la Communauté, et en particulier pour s’assurer de la réalité et de la régularité des opérations financées par le Fonds européen agricole de garantie (FEAGA) et par le Fonds européen agricole de développement rural (Feader), pour prévenir et poursuivre les irrégularités et pour récupérer les sommes perdues à la suite d’irrégularités ou de négligence.

In order to take account of those differences, two European agricultural funds should be created, namely the European Agricultural Guarantee Fund (hereinafter ‘EAGF’), for the financing of market measures, and the European Agricultural Fund for Rural Development (hereinafter ‘EAFRD’), for the financing of rural development programmes.
Pour pouvoir tenir compte de ces différences, il y a lieu de créer deux fonds agricoles européens, le premier, le Fonds européen agricole de garantie (ci-après dénommé «FEAGA»), finançant les mesures de marché et d'autres mesures et, le second, le Fonds européen agricole pour le développement rural (ci-après dénommé «FEADER»), destiné à financer les programmes de développement rural.
