In its annual reports on monitoring the application of Community law, the Commission has regularly acknowledged the vital role played by the complainant in detecting infringements of Community law, compliance with which it ensures on the basis of, inter alia, the infringement procedure laid down by Article 226 of the Treaty establishing the European Community and Article 141 of the Treaty establishing the European Atomic Energy Community.
Dans le cadre de ses rapports annuels sur le contrôle de l'application du droit communautaire, la Commission a, à plusieurs reprises, reconnu le rôle essentiel du plaignant dans la détection des infractions au droit communautaire, dont elle assure le respect notamment au moyen de la procédure en manquement visée à l'article 226 du traité instituant la Communauté européenne et à l'article 141 du traité instituant la Communauté européenne de l'énergie atomique.

"Infringement proceedings" shall mean the pre-litigation phase of the procedures for non-compliance lodged by the Commission on the basis of Article 226 of the Treaty establishing the European Community (EC Treaty) or Article 141 of the Treaty establishing the European Atomic Energy Community (Euratom Treaty).

(13) It is in the interest of the functioning of the internal market to have standards for the electromagnetic compatibility of equipment which have been harmonised at Community level; once the reference to such a standard has been published in the Official Journal of the European Communities, compliance with it should raise a presumption of conformity with the relevant essential requirements, although other means of demonstrating such conformity should be permitted.
(13) L'existence de normes qui ont été harmonisées au niveau communautaire en ce qui concerne la compatibilité électromagnétique est dans l'intérêt du fonctionnement du marché intérieur. (13) Under Article 274 of the Treaty, Member States are to cooperate with the Commission to ensure compliance with the principles of sound financial management. To that end this Regulation specifies the conditions allowing the Commission to exercise its responsibilities for the execution of the general budget of the European Communities under the scrutiny of the European Parliament in its budgetary authority capacity ;

Pursuant to Article 6(5) of Directive 2002/96/EC the treatment operation may also be undertaken outside the respective Member State or the Community, provided that the shipment of waste is in compliance with Council Regulation (EEC) No 259/93 of 1 February 1993 on the supervision and control of shipments of waste within, into and out of the European Community .
Conformément à l'article 6, paragraphe 5, de la directive 2002/96/CE, l'opération de traitement peut également être entreprise en dehors de l'État membre concerné ou de la Communauté, pour autant que le transport des déchets soit conforme au règlement (CEE) no 259/93 du Conseil du 1er février 1993 concernant la surveillance et le contrôle des transferts de déchets à l'entrée et à la sortie de la Communauté européenne .

The treatment operation may also be undertaken outside the respective Member State or the Community provided that the shipment of WEEE is in compliance with Council Regulation (EEC) No 259/93 of 1 February 1993 on the supervision and control of shipments of waste within, into and out of the European Community. In this case, Member States shall ensure that producers deliver the WEEE to establishments or undertakings which meet minimum standards corresponding to the conditions set out in this Article, unless proof of re-use of whole appliances can be given. Member States may oppose shipments which comply with Regulation (EEC) No 259/93 if the minimum quality standards for treatment as laid down in paragraph 1 are not met.
Dans ce cas, les États membres s'assurent que les producteurs livrent les DEEE à des établissements ou à des entreprises répondant aux critères minimaux conformes aux conditions définies au présent article, à moins qu'il ne soit prouvé que les équipements sont entièrement réutilisables. Les États membres peuvent s'opposer aux livraisons, même si elles sont conformes au règlement (CEE) nº 259/93, lorsque les critères minimaux de qualité du traitement définis au paragraphe 1 ne sont pas remplis.
