As this proposal constitutes a development of the Schengen acquis and following Article 5 of the Protocol, “Denmark shall decide within a period of 6 months after the Council has decided on a proposal or initiative to build upon the Schengen acquis under the provisions of Title IV of the Treaty establishing the European Community, whether it will implement this decision in its national law”.
La présente proposition constitue un développement de l'acquis de Schengen et, aux termes de l'article 5 du protocole, «[l]e Danemark décide, dans un délai de six mois après que le Conseil a arrêté une décision au sujet d'une proposition ou d'une initiative visant à développer l'acquis de Schengen en application des dispositions du titre IV du traité instituant la Communauté européenne, s'il transpose cette décision dans son droit national».

In this respect, the Commission must point out that, in accordance with the established case-law of the Court of Justice of the European Communities, it enjoys a discretionary power in deciding whether or not to commence infringement proceedings and to refer a case to the Court [2].

(11) In accordance with Articles 1 and 2 of the Protocol on the position of Denmark annexed to the Treaty on European Union and to the Treaty establishing the European Community, Denmark is not taking part in the adoption of this Decision and is not bound by it or subject to its application. Given that this Decision builds upon the Schengen acquis under the provisions of Title IV of Part Three of the Treaty establishing the European Community, Denmark has, in accordance with Article 5 of the said Protocol, to decide within a period of six months after the date of adoption of this Decision whether it will implement it in its national law.

5. Notwithstanding the self-certification procedures specified in Paragraph 2 above, each Management Entity reserves the right to test or otherwise review products that are or have been sold within its territories (in the territories of the European Community Member States in the case of the Commission) to determine whether the products are certified in accordance with the Common Specifications set forth in Annex C. The Management Entities shall communicate and cooperate fully with one another to ensure all products bearing the Common Logo meet the Common Specifications set forth in Annex C.
5. The question as to whether or not we should now regulate MEPs’ privileges and immunities boils down to the question of whether this European Community is a community or an international organisation, of whether we are a parliamentary assembly or a parliament worthy of the name.

Consequently, and in accordance with Article 10 of the Treaty establishing the European Community, Member States individually and collectively have the obligation to take all appropriate measures, whether general or particular, to ensure fulfilment of the obligations resulting from action taken by the institutions of the Community, including the Community's quantified emission reduction commitment under the Protocol, to facilitate the achievement of this commitment and to abstain from any measure that could jeopardise the attainment of this commitment.

(3) The general system Directives permit the host Member State to require, subject to certain conditions, the applicant to take compensation steps, notably where substantial differences exist between the theoretical and/or practical education and training undergone and that covered by the qualification required in the host Member State; under Articles 39 and 43 of the Treaty, as interpreted by the Court of Justice of the European Communities(6), the host Member State must assess whether professional experience is sufficient in order to prove possession of the knowledge which is lacking; in the interests of clarity and legal certainty for individuals wishing to practise their profession in another Member State, it is desirable to incorporate into the general system Directives the requirement that the host Member State has to examine whether the professional experience gained by the applicant since obtaining his qualification(s) covers the subjects referred to above.
(3) Les directives relatives au système général permettent à l'État membre d'accueil d'exiger, sous certaines conditions, des mesures de compensation de la part du demandeur, notamment lorsque la formation qu'il a reçue porte sur des matières théoriques et/ou pratiques substantiellement différentes de celles couvertes par le diplôme requis dans l'État membre d'accueil. The question has been raised as to whether it is conceivable that the content of certain measures decided on by the Community within the context of Title IV of the Treaty establishing the European Community may be made applicable in Denmark in any other way.

These amendments introduce measures intended to make it possible to draw up reliable forecasts for the market based on thorough assessment of the means of production; to establish regulatory funds in all Member States, supported by Community aid, so that any pig producer in the European Union, whether breeder or fattener, who wants to join can do so in return for a commitment to stabilise output for five years; to establish conditions for the cofinancing of these funds by producers or their producer associations and by the European Union in order to encourage producers to join; to adjust the aid payments from these funds during periods of crisis and finally, to commit Member States to adopting, together with the Commission, the measures which appear to them to be best suited to restoring the balance of the markets in the event of a crisis. This effort to firm up the market must take into account developments in production in each Member State and must have a bearing on producers who do not join the regulatory funds.
En l'occurrence, il s'agit de permettre l'établissement de prévisions fiables concernant le marché par une bonne connaissance des moyens de production ; d'instaurer des fonds de régulation dans tous les États membres, avec une aide communautaire à leur mise en place afin que tout éleveur de l'Union, naisseur ou engraisseur, désireux d'y adhérer puisse le faire moyennant un engagement à stabiliser sa production pendant cinq ans ; d'établir le cofinancement de ces fonds par les éleveurs ou leurs regroupements et par l'Union européenne, afin d'encourager l'adhésion des producteurs ; d'introduire des modulations dans les versements des aides de ces fonds pendant les périodes de crise ; d'engager, enfin, les États membres à prendre, avec la Commission, les mesures qui leur paraîtront les mieux adaptées au rétablissement de l'équilibre des marchés en cas de crise avérée, étant entendu que cet effort de redressement du marché doit s'appliquer en tenant compte des évolutions de la production dans chaque État membre et doit être répercuté sur les éleveurs non adhérents au fond de régulation.
