WHEREAS the Council of the European Union has adopted Council Regulation (EC) No 343/2003 of 18 February 2003 establishing the criteria and mechanisms for determining the Member State responsible for examining an asylum application lodged in one of the Member States by a third-country national (hereinafter referred to as the Dublin Regulation), which replaced the Convention determining the State responsible for examining applications for asylum lodged in one of the Member States of the European Communities, signed in Dublin on 15 June 1990 (hereinafter referred to as the Dublin Convention), and whereas the Commission of the European Communities has adopted Regulation (EC) No 1560/2003 of 2 September 2003 laying down detailed rules for the application of Council Regulation (EC) No 343/2003 establishing the criteria and mechanisms for determining the Member State responsible for examining an asylum application lodged in one of the Member States by a third-country national, hereinafter referred to as the ‘Dublin implementing Regulation’.
CONSIDÉRANT que le Conseil de l'Union européenne a adopté le règlement (CE) no 343/2003 du 18 février 2003 établissant les critères et mécanismes de détermination de l'État membre responsable de l'examen d'une demande d'asile présentée dans l'un des États membres par un ressortissant d'un pays tiers (ci-après dénommé «règlement Dublin»), qui a remplacé la convention de Dublin relative à la détermination de l'État responsable de l'examen d'une demande d'asile présentée dans l'un des États membres des Communautés européennes, signée à Dublin le 15 juin 1990 (ci-après dénommée «convention de Dublin»), et que la Commission des Communautés européennes a adopté le règlement (CE) no 1560/2003 du 2 septembre 2003 portant modalités d'application du règlement (CE) no 343/2003 du Conseil établissant les critères et mécanismes de détermination de l'État membre responsable de l'examen d'une demande d'asile présentée dans l'un des États membres par un ressortissant d'un pays tiers (ci-après dénommé «règlement modalités d'application de Dublin»).

WHEREAS the provisions of Title IV of the Treaty establishing the European Community and the acts adopted on the basis of that Title do not apply to the Kingdom of Denmark pursuant to the Protocol on the position of Denmark annexed by the Treaty of Amsterdam to the Treaty on European Union and to the Treaty establishing the European Community, but it should be made possible for the Swiss Confederation and Denmark to apply the substantive provisions of this Agreement in their relations with each other.
CONSIDÉRANT que les dispositions du titre IV du traité instituant la Communauté européenne et des actes adoptés sur la base dudit titre ne s'appliquent pas au Royaume de Danemark en vertu du protocole sur la position du Danemark annexé par le traité d'Amsterdam au traité sur l'Union européenne et au traité instituant la Communauté européenne, mais qu'il convient de créer la possibilité pour la Confédération suisse et le Danemark d'appliquer, dans leurs relations mutuelles, les dispositions de fond du présent accord.

WHEREAS an Agreement should be concluded between the European Community and the Swiss Confederation containing rights and obligations similar to those agreed between the European Community, of the one part, and Iceland and Norway, of the other part.
CONSIDÉRANT qu'il est approprié de conclure entre la Communauté européenne et la Confédération suisse un accord qui comporte des droits et des obligations analogues à ceux convenus entre la Communauté européenne, d'une part, et l'Islande et la Norvège, d'autre part.

WHEREAS the participation of the Swiss Confederation in the Community acquis covered by the Dublin and Eurodac Regulations (hereinafter referred to as the Dublin/Eurodac acquis) will help to strengthen cooperation between the European Community and the Swiss Confederation.
CONSIDÉRANT qu'une participation de la Confédération suisse à l'acquis communautaire couvert par les règlements «Dublin» et «Eurodac» (ci-après dénommé «l'acquis Dublin/Eurodac») permettra de renforcer la coopération entre la Communauté européenne et la Confédération suisse.

F. whereas the Kyoto Protocol was ratified by the European Community on 31 May 2002 as well as by its Member States and whereas the European Parliament and the Council adopted the legislative instruments necessary to implement the Kyoto Protocol provisions within the European Community; whereas on 13 October 2003 the European Parliament and the Council adopted Directive 2003/87/EC establishing a scheme for greenhouse gas emission allowance trading within the Community ; whereas a recent Commission progress report (COM(2004)0818) confirms that the EU as a whole is on track to meet its target under the Kyoto Protocol,

Whereas the United Kingdom of Great Britain and Northern Ireland has a special position in respect of matters covered by Title IV of Part Three of the Treaty establishing the European Community, as recognised in the Protocol on the position of the United Kingdom and Ireland and in the Protocol on the application of certain aspects of Article 14 of the Treaty establishing the European Community to the United Kingdom and to Ireland, annexed by the Treaty of Amsterdam to the Treaty on European Union and to the Treaty establishing the European Community.
