14. Recalls that, according to the Treaty, the European Council does not exercise legislative functions; insists, therefore, that the conclusions of the European Council are to be seen as negotiating instructions for the Council and that they in no case constitute red lines which cannot be negotiated with Parliament; calls for a standard formula recalling the provisions of Article 15(1) TFEU to be included in the conclusions of the European Council;

The Thessaloniki European Council of June 2003 approved the ‘Thessaloniki Agenda for the Western Balkans: moving towards European integration’, which provided for Community programmes to be opened up to the Stabilisation and Association Process (SAP) countries along the lines established for the participation of candidate countries.In its communication on ‘Preparing for the participation of the Western Balkan countries in Community programmes and agencies’, the Commission advocated concluding with Albania, Bosnia and Herzegovina, Croatia, the Former Yugoslav Republic of Macedonia and Serbia and Montenegro framework agreements laying down the general principles governing each country’s participation in Community programmes.In accordance with the negotiating directives adopted by the Council on 29 April 2004, the Commission, on behalf of the Community, has negotiated a Framework Agreement with Serbia and Montenegro on the general principles for its participation in Community programmes.This Agreement was signed, on behalf of the Community, on 22 November 2004 in Brussels, subject to conclusion at a later date.With regard to some of the programmes covered by the Agreement, the Treaty does not provide for powers other than those under Article 308.The specific terms and conditions regarding the participation of Serbia and Montenegro in the Community programmes, including the financial contribution payable, should be determined by the Commission on behalf of the Community.

13. Acknowledges that the realistic approach adopted at the Helsinki European Council, which once again deferred the adoption of a fiscal package, was not followed at the Feira European Council and fears that the agreement which has now been secured will, on account of the many derogations it includes, amount to no more than a means devised to ensure that this most recent European Council does not give the general public the impression of having been incapable of resolving issues which have been on its agenda for a number of years;
13. constate que le réalisme dont a fait preuve le Conseil européen d’Helsinki en reportant le «paquet fiscal» n'a pas été imité par le Conseil européen de Santa Maria da Feira et craint que l'accord qui a été conclu, eu égard notamment au nombre des dérogations qu'il prévoit, ne soit rien d'autre qu'une formule adoptée par le Conseil européen pour ne pas être considéré par l'opinion publique comme étant incapable de régler des questions qui restent inscrites à son ordre du jour depuis plusieurs années;

The European Council ought to be aware that in Europe today, the lowest per capita income and the highest levels of employment exist side by side in the same regions or countries. This requires a European employment policy with its own budget, linked to the Structural Funds policy that the European Council does not want to blindly accept.
Le Conseil européen devrait savoir que l'Europe voit coexister aujourd'hui, dans les mêmes pays et sur les mêmes territoires, un faible revenu par habitant et un taux de chômage élevé, qui exigent une politique européenne de l'emploi dotée d'un budget spécifique, associée à la politique des Fonds structurels que le Conseil européen ne souhaite pas accepter par aveuglement.
