The European Council first mooted the possibility of a European Human Rights Agency in the run-up to the 50th Anniversary of the Universal Declaration of Human Rights, celebrated by EU Foreign Ministers in Vienna in December 1998.

This situation was identified by the European Council in the Stockholm Programme, which calls on the EU institutions and Member States to ensure that legal initiatives remain consistent with fundamental rights " throughout the legislative process by way of strengthening the application of the methodology for a systematic and rigorous monitoring of compliance with the Convention and the rights set out in the Charter of Fundamental Rights "[17].
