Where a complainant considers that, in handling his/her complaint, the Commission has been guilty of maladministration by failing to follow any of the above measures, he/she may refer the matter to the European Ombudsman under Articles 21 and 195 of the EC Treaty.

The Commission was criticised for not processing these complaints fast enough by the European ombudsman following a complaint lodged with his office by the European Parliament (Case number: 289/2005) .

3. Decisions taken by the Authority pursuant to Article 8 of Regulation (EC) No 1049/2001 may be the subject of a complaint to the Ombudsman or of proceedings before the Court of Justice of the European Union, following an appeal to the Board of Appeal, as appropriate, in accordance with the conditions laid down in Articles 228 and 263 TFEU respectively.
3. Les décisions prises par l’Autorité en application de l’article 8 du règlement (CE) no 1049/2001 peuvent faire l’objet d’une plainte auprès du médiateur ou faire l’objet d’un recours devant la Cour de justice de l’Union européenne, à la suite d’un recours auprès de la commission de recours le cas échéant, dans les conditions prévues respectivement aux articles 228 et 263 du traité sur le fonctionnement de l’Union européenne.
