Today's Decision represents a positive response to many of the recommendations put forward by the European Ombudsman as a result of her own-initiative inquiry, and to the suggestions of Members of the European Parliament and representatives of civil society organisations.

13. Takes note that the Agency prepared an updated conflicts of interest policy and action plan in line with the European Ombudsman’s recommendations; calls on the Agency to make the draft public and to foster a debate on the policy and action plan prior their submission to the Management Board;

Suggests that when the Ombudsman presents his annual report in a meeting of the Committee on Petitions, not only representatives of the European Commission but also of the respective administrations of the European Parliament, the Council and other EU institutions, agencies, services and bodies that have been the subject of an investigation, a special report, critical remarks or other measures taken by the Ombudsman should be present to comment on the report and take part in the discussion; urges the administrations of Parliament, the Council and the other EU institutions, agencies and bodies concerned to be represented in future meetings when the Ombudsman's annual report is presented and discussed; believes that their participation in such discussions and the sharing of their views on good administration and on the problems overcome as a result of the European Ombudsman's recommendations and remarks could help to improve the service provided to EU citizens and interinstitutional dialogue and contribute to the establishment of a genuine service culture;

In the first place, it is true that the special report from the Ombudsman to the European Parliament of 18 October 1999 (1004/97/(PD)GG), available on the Ombudsman’s web-page, contains a recommendation to the Commission to the effect that, at the latest from 1 July 2000 onwards, the Commission should give candidates access to their own marked examination scripts upon request, and that press release 15/2000 of 31 July 2000, cited by the applicant, available on the Ombudsman’s web-page states that ‘[t]he Commission accepted the Ombudsman’s recommendation with effect from July 2000’.

Moreover, the European Ombudsman has stated that recruitment procedures must be governed by the principle of transparency, and has made recommendations to the Commission to that effect.

I would stress the crucial point in Proinsias De Rossa’s report, namely the first paragraph, which states that ‘the European Parliament endorses the European Ombudsman’s recommendation to the Commission’.

I can now confirm something which has already appeared in the White Paper on reform of the Commission, specifically in action 29 which is about improving transparency in a way which benefits candidates and in which it is stated that ‘Finally, pursuant to the European Ombudsman’s recommendation, the Commission will allow candidates access to their corrected tests in all competitions launched after July 2002’.
