Regulation (EU) No 528/2012 of the European Parliament and of the Council empowers the Agency to take certain individual decisions and entrusts the Board of Appeal established under Regulation (EC) No 1907/2006 with the competence to decide upon appeals brought against the decisions referred to in Article 77(1) of Regulation (EU) No 528/2012.

By the first ground of appeal, it is argued that the General Court misinterpreted the third indent of Article 4(2) of Regulation (EC) No 1049/2001 (1) of the European Parliament and of the Council of 30 May 2001 regarding public access to European Parliament, Council and Commission documents (‘the openness regulation’) by taking the view that the Commission, when it relies on the exception for investigations, may base its decision on a general presumption that access should be denied in an EU pilot procedure insofar as it constitutes a step which precedes the possible initiation of Treaty infringement proceedings, and that the Commission did not err in law in interpreting the above provision of the openness regulation as meaning that it could refuse a request for access to the requested documents in an EU pilot matter without examining the documents specifically and individually.

The review shall concern the questions whether – having regard to the case-law of the Court of Justice relating to the entitlement to paid annual leave as a principle of European Union social law, which is also expressly affirmed in Article 31(2) of the Charter of Fundamental Rights of the European Union and is covered in particular by Directive 2003/88/EC of the European Parliament and of the Council of 4 November 2003 concerning certain aspects of the organisation of working time (OJ 2003 L 299, p. 9) – the judgment of the General Court of the European Union of 8 November 2012 in Case T 268/11 P Commission v Strack affects the unity or consistency of European Union law inasmuch as the General Court, as an appeal court:

Thirdly, the Civil Service Tribunal observes that even though the outcome of reconciling the obligation to state reasons and observance of the principle of the secrecy of the selection board’s proceedings, in particular as to whether the communication of a single eliminatory individual mark to the candidate eliminated in the oral phase satisfies that obligation, is more often than not in favour of the principle of the secrecy of the selection board’s proceedings, the position may be otherwise when special circumstances exist, all the more so as the recent case-law concerning Regulation (EC) No 1049/2001 of the European Parliament and of the Council of 30 May 2001 regarding public access to European Parliament, Council and Commission documents (OJ 2001 L 145, p. 43) shows a development of Community case-law in favour of openness (see, to that effect, Case C‑64/05 P Sweden v Commission [2007] ECR I‑11389, and Joined Cases C‑39/05 P and C‑52/05 P Sweden and Turco v Council [2008] ECR I‑4723) (paragraph 40 of the judgment under appeal).

Proof of payment of the appeal fee which is required for any appeal pursuant to Commission Regulation (EC) No 340/2008 of 16 April 2008 on the fees and charges payable to the European Chemicals Agency pursuant to Regulation (EC) No 1907/2006 of the European Parliament and of the Council on the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH) should be attached to the notice of appeal and should be a condition for the admissibility of the appeal.
