In the Second Plea on the consequential error in law concerning the decision making procedure and the institutional prerogatives of the European Parliament to participate in the ordinary legislative procedure and of the European Economic and Social Committee to be duly consulted (violation of Articles 294 and 43(2) TFEU), the Commission submits that the part of the proposal concerned was adopted by the Council acting alone, while the European Parliament did not participate in its adoption as it would have done under the ordinary legislative procedure, and the European Economic and Social Committee was not adequately consulted.
Dans le second moyen, relatif à l’erreur de droit consécutive concernant la procédure de création de décision et aux prérogatives institutionnelles du Parlement européen de participer à la procédure législative ordinaire et du Comité économique et social européen d’être dûment consulté (violation des articles 294 et 43, paragraphe 2, du TFUE), la Commission soutient qu’une partie de la proposition concernée a été adoptée par le Conseil agissant seul, alors que le Parlement Européen n’a pas participé à son adoption comme il aurait dû le faire dans le cadre de la procédure législative ordinaire, et que le Comité économique et social européen n’a pas été adéquatement consulté.
