TRADUCTIONS EN CONTEXTE

It establishes a common court for the settlement of disputes relating to European patents and European patents with unitary effect (i.e. European patents that are granted based on a single application and which protect an invention in all countries in which the agreement applies).
Il institue une juridiction commune pour le règlement des litiges liés aux brevets européens et aux brevets européens à effet unitaire (c’est-à-dire les brevets européens délivrés sur la base d’une seule demande et qui protègent une invention dans l’ensemble des pays où s’applique l’accord).

Patent applicants should remain free to obtain either a national patent, a European patent with unitary effect, a European patent taking effect in one or more of the Contracting States to the EPC or a European patent with unitary effect validated in addition in one or more other Contracting States to the EPC which are not among the participating Member States.

(4) Community patent law applicable to the Community patent should not replace the laws of the Member States on patents, nor European patent law as established by the Munich Convention. It would not in fact appear to be justified to require undertakings to apply for registration of their patents as Community patents, since national patents and European patents continue to be necessary for those undertakings which do not want protection of their inventions at Community level. This Regulation should therefore be without prejudice to the right of the Member States to grant national patents.
(4) Le droit communautaire des brevets applicable au brevet communautaire ne doit pas se substituer aux droits des brevets des Etats membres ni au droit européen des brevets institué par la convention de Munich.En effet, il n'apparaît pas justifié d'obliger les entreprises à déposer leurs brevets comme brevets communautaires, les brevets nationaux et les brevets européens demeurant nécessaires aux entreprises ne désirant pas une protection de leurs inventions à l'échelle de la Communauté; en conséquence, le présent règlement ne porte pas atteinte au droit des Etats membres de délivrer des brevets nationaux.

This solution, which is necessary in order to preserve the unity of the Community patent nevertheless entails strict treatment of the Community patent compared with European patents, which are in effect national patents.

A non-centralised judicial system such as that for European patents, under which, for example, legal actions relating to the validity of a patent have to be instituted separately in all the Contracting States for which the patent has been granted, would be unacceptable for the Community patent.

By way of derogation from Articles 3(1), 3(2) and 4(1), a European patent for which unitary effect is registered in the Register for unitary patent protection shall have unitary effect only in those participating Member States in which the Unified Patent Court has exclusive jurisdiction with regard to European patents with unitary effect at the date of registration.

1. A European patent with unitary effect as an object of property shall be treated in its entirety and in all the participating Member States as a national patent of the participating Member State in which that patent has unitary effect and in which, according to the European Patent Register:

whereas, in particular, this enhanced cooperation may be regarded as furthering the Union's objectives, protecting its interests and reinforcing its integration process within the meaning of Article 20 TEU, in the light of the Commission's impact assessment in connection with its above-mentioned 2010 proposal for a regulation on the translation arrangements for the European Union patent, which pointed to the lack of a unitary patent providing protection across the entire EU leading to a fragmented patent system; whereas this fragmentation is caused by the high costs and complexity of validating European patents in individual Member States, which can amount to 40 % of the overall costs of patenting in Europe; whereas the creation of unitary patent protection for a group of Member States would improve the level of patent protection by making it possible to obtain uniform patent protection throughout the territories of the participating Member States and would eliminate the costs and complexity for those territories, thus fostering scientific and technological advances and the functioning of the internal market,
