The procedural administrative rules laid down in this Regulation aim at implementing the principles on good administration established in a large variety of legal sources in light of the case law of the Court of Justice of the European Union.
Les règles de procédure administrative énoncées dans le présent règlement ont pour but de mettre en œuvre les principes de bonne administration établis dans un large éventail de sources de droit à la lumière de la jurisprudence de la Cour de justice de l'Union européenne.

2. The objective of this Regulation is to guarantee the right to good administration enshrined in Article 41 of the Charter of Fundamental Rights of the European Union by means of an open, efficient and independent administration.
2. L'objectif du présent règlement est de garantir le droit à une bonne administration consacré à l'article 41 de la Charte des droits fondamentaux de l'Union européenne, au moyen d'une administration ouverte, efficace et indépendante.

Recalls that, in its resolution of 15 January 2013, Parliament called pursuant to Article 225 of the Treaty on the Functioning of the European Union (TFEU) for the adoption of a regulation on an open, efficient and independent European Union administration under Article 298 TFEU, but despite the fact that the resolution was adopted by an overwhelming majority (572 in favour, 16 against, 12 abstentions), Parliament’s request was not followed up by a Commission proposal.
rappelle qu'en vertu de l'article 225 du traité sur le fonctionnement de l'Union européenne (traité FUE), il a demandé, dans sa résolution du 15 janvier 2013, l'adoption d'un règlement sur une administration de l'Union européenne ouverte, efficace et indépendante, sur la base de l'article 298 du traité FUE, mais que sa demande n'a été suivie d'aucune proposition de la Commission, alors que sa résolution avait été votée à une écrasante majorité (572 voix pour, 16 voix contre et 12 abstentions).

Article 298 of the Treaty on the Functioning of the European Union (TFEU) provides for the adoption of regulations to assure that in carrying out their mission, the institutions, bodies, offices and agencies of the Union have the support of an open, efficient and independent European administration.
L'article 298 du traité sur le fonctionnement de l'Union européenne prévoit l'adoption de règlements visant à garantir que, dans l'accomplissement de leurs missions, les institutions, organes et organismes de l'Union s'appuient sur une administration européenne ouverte, efficace et indépendante.

The provisions on remuneration should be without prejudice to the full exercise of fundamental rights guaranteed by the Treaty on European Union (TEU), the Treaty on the Functioning of the European Union (TFEU) and the Charter of Fundamental Rights of the European Union (the Charter), to general principles of national contract and labour law, applicable legislation regarding shareholders’ rights and involvement and the general responsibilities of the administrative and supervisory bodies of the companies concerned, as well as to the right, where applicable, of the social partners to conclude and enforce collective agreements, in accordance with national law and practice.

Annuls the corrigendum, published in the Official Journal of the European Union of 21 March 2013, to notice of open competition EPSO/AD/177/10 to constitute a reserve list from which to recruit administrators in the fields of European public administration, law, economics, audit and information and communication technology, and the corrigendum, published in the Official Journal of the European Union of 21 March 2013, to notice of open competition EPSO/AD/178/10 and corrigendum to notice of open competition EPSO/AD/179/10 to constitute a reserve list from which to recruit administrators in the fields of, respectively, librarianship and information science and audiovisual, in so far as their nature and content have been identified in paragraphs 68 to 70 of the present judgment;

1. IMI shall be used for administrative cooperation between competent authorities of the Member States and between competent authorities of the Member States and the Commission necessary for the implementation of Union acts in the field of the internal market, within the meaning of Article 26(2) of the Treaty on the Functioning of the European Union (TFEU), which provide for administrative cooperation, including the exchange of personal data, between Member States or between Member States and the Commission.

Is the first sentence of Article 21g(2) of Law 241/1990, as interpreted by the administrative case-law — in relation to the obligation to state reasons for an administrative measure laid down by Article 3 of Law 241/1990 and by Sicilian Regional Law 10/1991, in conjunction with the obligation to state reasons for the acts of public authorities laid down by the second paragraph of Article 296 of the Treaty on the Functioning of the European Union and the third indent of Article 41(2) of the Charter of Fundamental Rights of the European Union — compatible with Article 1 of Law 241/1990, which requires the administrative authorities to apply the principles of European Union law, and, consequently, are the interpretation and application of that interpretation whereby the authorities may supplement a statement of reasons for an administrative measure in court proceedings compatible and admissible?

Are the interpretation and application of Article 3 of Law 241/1990 and of Article 3 of Sicilian Regional Law 10/1991 — in relation to Article 1 of Law 241/90, which requires the Italian administrative authorities to apply the principles of European Union law, pursuant to the obligation to state reasons for the acts of public authorities laid down in the second paragraph of Article 296 of the Treaty on the Functioning of the European Union and in the third indent of Article 41(2) of the Charter of Fundamental Rights of the European Union — to the effect that measures of public authorities in a private-law form — that is to say, measures relating to individual rights and which are in any event mandatory, in matters relating to pensions — may be exempt from the obligation to state reasons, compatible with European Union law, and does such a case amount to infringement of an essential procedural requirement governing an administrative measure?
Étant entendu que l'article 1er de la loi 241/1990 impose à l'administration italienne d'appliquer les principes de l'ordre juridique de l'Union européenne, et compte tenu du principe de motivation des actes de l'administration publique visé à l'article 296, deuxième alinéa, TFUE et à l'article 41, paragraphe 2, sous c), de la charte des droits fondamentaux, doit-on considérer comme compatibles avec le droit de l'Union européenne, l'interprétation et l'application de l'article 3 de la loi 241/1990 et de l'article 3 de la loi régionale de Sicile 10/1991, selon lesquelles les actes mixtes, c'est-à-dire ceux qui concernent les droits subjectifs et relèvent en tout état de cause de la compétence liée de l'administration en matière de pensions, sont susceptibles d'échapper à l'obligation de motivation, et cette situation s'analyse-t-elle comme une violation d'une forme substantielle de la décision administrative?
