According to the Treaty on the Functioning of the European Union (TFEU), judicial cooperation in criminal matters in the Union is to be based on the principle of mutual recognition of judgments and other judicial decisions.

Pursuant to Article 82(1) of the Treaty on the Functioning of the European Union (TFEU), judicial cooperation in criminal matters in the Union is to be based on the principle of mutual recognition of judgments and judicial decisions, which is, since the Tampere European Council of 15 and 16 October 1999, commonly referred to as a cornerstone of judicial cooperation in criminal matters within the Union.

Relevant European Union agencies, including the European Union Agency for Fundamental Rights (FRA), the European Institute for Gender Equality (EIGE), the European Foundation for the Improvement of Living and Working Conditions (Eurofound), the European Police College (CEPOL), the European Union’s Judicial Cooperation Unit (Eurojust), the European Judicial Network (EJN) and the European Asylum Support Office (EASO), should mainstream issues related to sexual orientation and gender identity in their work, and continue to provide the Commission and Member States with evidence-based advice on the fundamental rights of LGBTI people;

(2a) According to Article 82 of the Treaty on the Functioning of the European Union ('TFEU'), judicial cooperation in criminal matters in the Union shall be based on the principle of mutual recognition of judgments and judicial decisions.

3. Notwithstanding the provisions contained in any instruments adopted by the European Union regarding judicial cooperation, a competent authority may report to Eurojust recurrent refusals or difficulties concerning the execution of requests for, and decisions on, judicial cooperation, including regarding instruments giving effect to the principle of mutual recognition, and request the College to issue a written non-binding opinion on the matter, provided it could not be resolved through mutual agreement between the competent national authorities or through the involvement of the national members concerned.
3. Sans préjudice des dispositions figurant dans des instruments adoptés par l’Union européenne en matière de coopération judiciaire, l’autorité compétente peut signaler à Eurojust les difficultés ou refus récurrents concernant l’exécution de demandes de coopération judiciaire et de décisions dans ce domaine, relatives notamment à des instruments donnant effet au principe de reconnaissance mutuelle, et demander au collège de rendre par écrit un avis non contraignant sur la question, pour autant que celle-ci ne puisse être résolue par accord mutuel entre les autorités nationales compétentes ou grâce à l’intervention des membres nationaux concernés.

Considers that the Treaty of Nice introduces substantial improvements to the European Union’s judicial system which should be consolidated through prompt ratification of the Treaty; considers that, if it appears unlikely that the Treaty of Nice will be ratified as a whole, it will be necessary to ensure that the substantial reforms introduced by that Treaty enter into force separately to allow the Community’s judicial system to operate; hopes that this system will be effectively completed at the 2004 Intergovernmental Conference;
