The applicant claims that, by infringing its obligation to conduct a diligent and impartial examination and thereby subsequently affirming, in a manifestly erroneous manner, the applicability in full of the communication on the detailed examination of large investment projects, the defendant infringed Article 108(3) TFEU.

The evaluation shall examine the way and extent to which the Agency effectively contributes to the operational management of large-scale IT systems in the area of freedom, security and justice and fulfils its tasks laid down in this Regulation.
L’évaluation analyse de quelle manière et dans quelle mesure l’agence contribue effectivement à la gestion opérationnelle de systèmes d’information à grande échelle au sein de l’espace de liberté, de sécurité et de justice, et s’acquitte des tâches qui lui sont conférées par le présent règlement.

3. In cases where the examination has been limited in accordance with this Article, an individual margin of dumping shall, nevertheless, be calculated for any exporter or producer not initially selected who submits the necessary information within the time-limits provided for in this Regulation, except where the number of exporters or producers is so large that individual examinations would be unduly burdensome and would prevent completion of the investigation in good time.
3. Lorsque l'examen est limité conformément au présent article, une marge de dumping individuelle est néanmoins calculée pour chaque exportateur ou producteur n'ayant pas été choisi initialement qui présente les renseignements nécessaires dans les délais prévus par le présent règlement, sauf dans les cas où le nombre d'exportateurs ou de producteurs est si important que des examens individuels compliqueraient indûment la tâche et empêcheraient d'achever l'enquête en temps utile.

1. Where a large enterprise receives restructuring aid examined under these Guidelines, monitoring of the satisfactory implementation of the EFTA Surveillance Authority's decisions on such aid requires a large measure of transparency with regard to any further aid which the firm might receive, even in accordance with a scheme that has already been authorised and even where such aid is not subject to individual notification under point 16.5.1.

Whereas initial examination of that information has shown that in certain of the countries concerned the production and inspection rules applied appear largely to satisfy the requirement of equivalence laid down in Article 11 (2) of Regulation (EEC) No 2092/91; whereas, however, the information must be examined in greater depth and examination completed; whereas, consequently, the stage of the examination currently reached does not permit a decision to be taken concerning the inclusion of those third countries in the list provided for in Article 11 (1) of Regulation (EEC) No 2092/91;

Whereas from a first examination of the information it has resulted that in certain of these countries production and inspection rules are applied which appear largely satisfy the requirement of equivalency provided for in Article 11 (2) of Regulation (EEC) No 2092/91; whereas however on certain points the examination has to be completed and studied in detail, with the consequence that the stage in examining the information does not permit a decision to be taken regarding the inclusion of these third countries in the list provided for in Article 11 (1) before 1 January 1993, the date of implementation of this provision;
