(5) Where a member of the forces who has been awarded an exceptional incapacity allowance under this section dies, the exceptional incapacity allowance shall, if that member was a member to whom an additional pension was, at the time of death, payable in respect of the member’s spouse, common-law partner or child living with the member, be paid for a period of one year commencing on the first day of the month following the month of the death, to the survivor, if living, or, if not living, equally to any of the member’s children otherwise pensionable under this Act.

In response to a written question tabled in the Senate on November 4, 2013, Julian Fantino, the Minister of Veterans Affairs, confirmed that as of August 31, 2013, an incalculable amount of the promised " two billion dollars'' of changes to the New Veterans Charter had been spent on 2717 veterans who were receiving increased monthly financial compensation through the earnings loss benefit; 590 veterans who were receiving increased access to the Permanent Incapacity Allowance; and 202 veterans who were receiving access to the Exception Incapacity Allowance.

It proposes some important changes: at least $58,000 per year for seriously wounded or ill veterans, those too injured to return to the workforce; a minimum of $40,000 per year no matter what the salary when serving in the Canadian Forces for those receiving the monthly earnings loss benefit; an additional monthly payment of $1,000 for life to help our most seriously wounded veterans who are no longer able to work; and improved access to the permanent impairment allowance and the exceptional incapacity allowance, which will include 3,500 more veterans.

Clause 20 provides that a member will be considered eligible for an exceptional incapacity allowance if he or she is suffering from an exceptional incapacity, is receiving a pension or a disability award for that disability, and if the total disability assessment under one or both of the Acts is equal to or greater than 98%.
