2. If an exporter is aware that items which it proposes to export, not listed in Annex II, III or IIIa, are intended, in their entirety or in part, for the purpose of capital punishment or for the purpose of torture and other cruel, inhuman or degrading treatment or punishment, it shall notify the authorities of the Member State in which it is established, which shall decide whether or not it is expedient to make the export concerned subject to authorisation.
2. Si un exportateur sait que des biens qui ne figurent pas à l'annexe II, à l'annexe III ou à l'annexe III a et qu'il entend exporter sont destinés, entièrement ou en partie, à être utilisés pour infliger la peine capitale, la torture ou d'autres peines ou traitements cruels, inhumains ou dégradants, il en avertit les autorités compétentes de l'État membre dans lequel il est établi, lesquelles décident de l'opportunité de soumettre l'exportation concernée à autorisation.

3. The competent authorities of the Member States shall not grant any authorisation for any sale, supply, transfer or export of the equipment or the provision of the services, as referred to in paragraphs 1 and 2, if they determine that the sale, supply, transfer or export concerned or the provision of the service concerned is destined for one of the categories of exploration and production referred to in paragraph 1.
3. Les autorités compétentes des États membres n'accordent aucune autorisation de vente, de fourniture, de transfert ou d'exportation des équipements ou encore de fourniture de services, tels qu'ils sont visés aux paragraphes 1 et 2, si elles établissent que la vente, la fourniture, le transfert ou l'exportation en question ou la fourniture du service concerné sont destinés à l'une des catégories d'exploration ou de production visées au paragraphe 1.

3. The competent authorities of the Member States shall not grant any authorisation for any sale, supply, transfer or export of the technologies or the provision of the services referred to in paragraphs 1 and 2 if they determine that the sale, supply, transfer or export concerned or the provision of the service concerned is destined for deep water oil exploration and production, arctic oil exploration and production or shale oil projects in Russia.
3. In the case of breach or withdrawal of undertakings by any party to the undertaking, or in the case of withdrawal of acceptance of the undertaking by the Commission, the acceptance of the undertaking shall be withdrawn by the Commission, as appropriate, and the provisional duty which has been imposed by the Commission in accordance with Article 12, or the definitive duty which has been imposed in accordance with Article 15(1), shall apply, provided that the exporter concerned, or the country of origin and/or export has, except in the case of withdrawal of the undertaking by the exporter or such country, been given an opportunity to comment.

In case of breach or withdrawal of undertakings by any party to the undertaking, or in case of withdrawal of acceptance of the undertaking by the Commission, the acceptance of the undertaking shall, after consultation, be withdrawn by Commission Decision or Commission Regulation, as appropriate, and the provisional duty which has been imposed by the Commission in accordance with Article 12 or the definitive duty which has been imposed by the Council in accordance with Article 15(1), shall apply, provided that the exporter concerned, or the country of origin and/or export has, except in the case of withdrawal of the undertaking by the exporter or such country, been given an opportunity to comment.
