Germany denies that the measure confers a selective advantage upon Sachsen LB. The Commission would recall that under Article 87(1) EC any measure financed with state resources which favours an undertaking normally constitutes state aid, unless the measure would have also been taken by an investor operating under normal market economy conditions.
L’Allemagne conteste que la Sachsen LB tire un avantage sélectif de la mesure en cause. La Commission rappelle que toute intervention financée par des aides de l’État et de nature à apporter un avantage à une entreprise constitue normalement une aide d’État au sens de l’article 87, paragraphe 1, du traité CE sauf si un investisseur opérant en économie de marché normale aurait également pris cette mesure.
