If the budget has not been finally adopted at the latest two weeks before the entry for January of the following financial year, the Member States shall enter on the first working day of each month, including January, one-twelfth of the amount of the VAT-based own resource, and the GNI-based own resource, taking into account the effect on these resources of the correction granted to the United Kingdom for budgetary imbalances and of the gross reduction granted to Denmark, the Netherlands, Austria and Sweden, entered in the last budget finally adopted; the adjustment shall be made on the first due date following final adoption of the budget if it is adopted before the sixteenth of the month.

D. whereas this Draft amending budget includes only the part of the original request of the Court of Justice of the European Union which is based on the Declaration number 38 annexed to the final act of the Intergouvernemental Conference which adopted the Lisbon Treaty, omitting the nine law clerks requested by the Court of Justice of the European Union,

12. Calls on the Intergovernmental Conference to incorporate the draft decision of the European Council establishing the composition of the European Parliament, as set out in Annex 1 to this resolution, in a declaration on Article [9a](2) of the Treaty on European Union as incorporated in the draft amending treaty to be attached to the final act of the said Conference with the proviso that it will be formally adopted in accordance with the procedure laid down in the aforementioned Article [9a](2) immediately after the entry into force of the amending treaty; undertakes, for its part, to act without delay once the amending treaty has entered into force; calls on the European Council to give effect to the aforementioned declaration, as soon as the amending treaty enters into force and in accordance with its provisions, so that the Member States can enact, in good time, the necessary domestic provisions for organising the elections to the European Parliament for the 2009-2014 parliamentary term;
12. demande à la Conférence intergouvernementale de reprendre dans une déclaration - à joindre à l'Acte final de ladite Conférence - sur l'article [9 A], paragraphe 2, du traité sur l'Union européenne, tel qu'il est repris dans le projet de traité modificatif, le projet de décision du Conseil européen fixant la composition du Parlement européen figurant à l'annexe 1 de la présente résolution, étant entendu que son adoption formelle conformément à la procédure prévue à l'article [9 A], paragraphe 2, précité, aura lieu immédiatement après l'entrée en vigueur du traité modificatif; s'engage, en ce qui le concerne, à faire diligence dès l'entrée en vigueur du traité modificatif; invite le Conseil européen à mettre en œuvre la déclaration mentionnée plus haut dès que le traité modificatif entrera en vigueur et conformément à ses dispositions, afin de permettre aux États membres de prendre les dispositions internes nécessaires en temps utile pour l'organisation des élections au Parlement européen pour la législature 2009-2014;

In addition to that, we would not only like a state of play from the Commission as to which of the outstanding regulations we could have withdrawn, but above all what we would like is to be sure that we have clarity between what we have here in the budget process and the legislative process of the work programme which is decided on by the Commission today; so that when we have a final decision on this budget, hopefully in December, and the resolution from Parliament on the legislative work programme, then both of these can be bound together and we can have the Commission President come to Parliament in February 2007 and tell us what the final work programme of the Union is. Otherwise it is unclear to citizens.

If the budget has not been finally adopted before the beginning of the financial year, the Member States shall enter on the first working day of each month, including January, one-twelfth of the amount of VAT own resources, of the additional resource, with the exception of the amounts for financing the EAGGF monetary reserve, and, where appropriate, of the GNP financial contributions entered in the last budget finally adopted; the adjustment shall be made on the first due date following final adoption of the budget if it is adopted before the 16th of the month.

Finally, the Conference agreed to attach, for illustrative purposes, to this Final Act the texts of the Treaty on European Union and the Treaty establishing the European Community, as they result from the amendments made by the Conference.
