Colleagues, I call upon all of you to exercise your responsibility with due care and withhold discharge to the Commission, to Parliament, to the Council, to the European Development Fund and to the Court of Auditors, that does not publish the declaration of financial interests, until all of these institutions give proof of sound financial management.
Mes chers collègues, je vous invite tous à assumer consciencieusement vos responsabilités et à refuser la décharge à la Commission, au Parlement, au Conseil, au Fonds européen de développement et à la Cour des comptes, qui ne publie pas les déclarations d’intérêts financiers, aussi longtemps que ces institutions n’auront pas apporté la preuve d’une gestion financière saine.

4. Notes that, on account of the mid-term reconstitution of Parliament’s bodies in accordance with the Rules of Procedure, the Advisory Committee provided for in Article 7 of the Code of Conduct set out in Annex I to the Rules of Procedure as a result of this decision cannot be established before the end of January 2012; decides, therefore, that Members will have 90 days following the entry into force of the Code of Conduct to submit the declaration of financial interests referred to in Article 4 of that Code, and that declarations submitted on the basis of the provisions of the Rules of Procedure in force on the date this decision is adopted will remain valid until the expiry of the aforementioned deadline; decides, furthermore, that the latter provisions will also apply to any Member who takes office during that period;
4. note que, en raison de la reconstitution, conformément au règlement, des organes du Parlement à la mi-législature, le comité consultatif prévu à l'article 7 du code de conduite figurant à l'annexe I du règlement, telle qu'elle résultera de la présente décision, ne pourra pas être institué avant la fin du mois de janvier 2012; décide en conséquence que les députés disposeront de 90 jours après l'entrée en vigueur du code de conduite pour présenter la déclaration d'intérêts financiers visée à l'article 4 de ce code et que les déclarations déposées sur la base des dispositions du règlement en vigueur à la date d'adoption de la présente décision resteront valables jusqu'à l'expiration du délai précité; décide en outre que ces dernières dispositions s'appliqueront également à tout député dont le mandat prendrait effet durant cette même période;

For the purposes of point (a), a pledge, or a similar security interest, of financial instruments in connection with the depositing of the financial instruments in a custody account does not need to be notified, unless and until such time that such pledge or other security interest is designated to secure a specific credit facility.

On the basis of that Decision, the European Financial Reporting Advisory Group (EFRAG), the International Financial Reporting Standards Foundation (the IFRS Foundation), which is the legal successor to the International Accounting Standards Committee Foundation (IASCF), and the Public Interest Oversight Board (PIOB) benefited from Union co-financing in the form of operating grants until 31 December 2013.

Interest and other gains attributable to support from the ESI Funds paid to financial instruments shall be used for the same purposes, including the reimbursement of management costs incurred or payment of management fees of the financial instrument in accordance with point (d) of the first subparagraph of Article 42(1) and in accordance with Article 42(2) and (3), as the initial support from the ESI Funds, either within the same financial instrument or, following the winding up of the financial instrument, in other financial instruments or forms of support ◄ in accordance with the specific objectives set out under a priority, until the end of the eligibility period.

- The second proposal is that there should be a five-year time-bar on the recovery of sums owed to the Community. This limit could be extended in cases where active steps are being taken to secure recovery. As things stand, there is no general time-limit of a ‘Community’ nature (such a limit exists in certain sectoral regulations e.g. those concerning the Staff Regulations: 5 years, the regulation on the protection of the communities’ financial interests: 4 years). However, there is interference with the national legislation, where the contract refers to national law or where the judge is a national one applying his own law as the law of procedure. This could give rise to total chaos in those Member States where institutions’ right to collect debts is time-barred (after 3 or 10 years), or where, quite simply, no information is given on whether the deadline has lapsed until the case comes before the judge. Nor is it clear whether after the period has elapsed it is possible to accept compensation or spontaneous payment by the debtor. In brief, this proposal would introduce legal certainty for both the institutions and the debtors.
- La seconde consiste à prévoir un délai de prescription de cinq ans pour le recouvrement des créances communautaires -ce délai pouvant éventuellement être prolongé en cas de poursuites actives en vue du recouvrement: à l'heure actuelle, il n'y pas de délai général de prescription "communautaire" ( il y a un délai dans certains règlements sectoriels, par exemple en ce qui concerne le statut: 5 ans, le règlement PIF, protection des intérêts financiers: 4 ans, mais il y a interférence avec les droits nationaux applicables, car le contrat fait référence à ce droit national ou parce que le juge saisi est un juge national qui applique sa propre loi comme loi de procédure. Ceci aboutit à une cacophonie épouvantable dans certains États membres où la créance des institutions est prescrite après 3 ou 10 ans, ou encore l'on est simplement maintenue dans l'ignorance quant à savoir si la créance est prescrite, avant d'en saisir le juge. On ne sait pas non plus si après la prescription on peut encore compenser ou accepter un paiement spontané du débiteur. Bref, la proposition introduit de la sécurité pour les institutions et pour les débiteurs.

I call on those who truly believe in European integration to be consistent and to support the plan for a stronger European Union, that is, which can avail itself of all the necessary means in order to exert real influence on the scourge of fraud prejudicial to the Union’s financial interests, since until now, these interests have not been adequately protected by the Member States with their laws.
J'invite ceux qui croient vraiment à l'intégration européenne à être cohérents et à soutenir le projet d'une Union européenne plus forte, c'est-à-dire une Union qui puisse se doter de tous les moyens nécessaires pour avoir une incidence réelle sur le fléau qu'est la fraude aux dépens des intérêts financiers de l'Union, puisque jusqu'ici ces intérêts n'ont pas été suffisamment protégés par les États membres et leurs législations.
