Third, it modernizes the fines and provides additional tools in the form of administrative monetary penalties, thus providing both stiffer fines and a more flexible approach to address less egregious infractions to promote compliance in the marketplace.

In summary, the UNEQ believes that Bill C-32, which purports to modernize the Act, actually greatly increases the number of exceptions, thus depriving writers and artists of fair compensation; denies their right to approve or not the use of their works; remains vague as to the meaning of the terms used in the bill, leaving it up to the courts to interpret them; sets laughable fines, compared to the costs that would be incurred; removes any accountability for Internet service providers; ignores Canadian copyright collective societies' successful negotiations; and endangers the book industry and the development of new markets in the educational sector.
En résumé, l'UNEQ est d'avis que le projet de loi C-32, sous couvert d'une modernisation, multiplie les exceptions qui privent les écrivains et les artistes d'une rémunération équitable, nie leur droit d'autoriser ou non l'utilisation de leurs oeuvres, reste vague quant à la portée des termes inscrits dans la loi, s'en remettant aux tribunaux pour les interpréter, fixe des amendes dérisoires au regard des frais à encourir, déresponsabilise les fournisseurs des services Internet, fait fi du travail de négociation réalisé par les sociétés de gestion collective et fragilise l'industrie du livre et le développement de nouveaux marchés dans le secteur de l’éducation.
