The firm had repaid part of the aid (ÖS 67 million) to the Vienna Municipal Council, the sum repaid being the amount of aid which the Commission had deemed incompatible with Article 23 of the Free Trade Agreement. The Commission regarded the repayment as having eliminated the distortion of competition and had accordingly proposed that the Regulation be repealed.
La Commission a estimé que le remboursement partiel de cette aide, effectué par la firme concernée à hauteur d'un montant total de 67 million ÖS au profit de la ville de Vienne, montant correspondant à l'aide considérée comme incompatible avec l'article 23 de l'Accord de libre-échange par la Commission, avait pour effet d'éliminer la distorsion de concurrence relevée antérieurement et a proposé par conséquent l'abrogation de ce règlement.
