Definition: Nocturnal episodes of extreme terror and panic associated with intense vocalization, motility, and high levels of autonomic discharge. The individual sits up or gets up, usually during the first third of nocturnal sleep, with a panicky scream. First plea in law, alleging infringement of Articles 51(1) and 53(1) of the Rules of Procedure of the Civil Service Tribunal (CST) and of the principle of the equality of the parties in the proceedings, in that the period of two months laid down for lodging the defence, extended by ten days on account of distance, was calculated from the date of service of the notification that the application was in order, and not the date of service of the application, so that the defence lodged by the Committee of the Regions (CoR) was placed on the case file for the proceedings even though it had been lodged out of time; the CST then relied on that defence in order to dismiss the action by way of an order on the basis of Article 81 of the Rules of Procedure, and the appellant was thus deprived of the possibility of applying for judgment by default of the basis of Article 121 of the Rules of Procedure.

If, in its forthcoming judgments, the Court of Justice does not uphold Ferring but considers that compensation for public service constitutes state aid, the two-stage procedure proposed by the Commission in its report to the Laeken European Council may be continued, i.e. in a first stage, preparation of a Community framework then, in a second stage, in the light of experience acquired in applying that framework and, if necessary and guided by experience, preparation of a regulation exempting some forms of aid for general economic interest services from the prior notification obligation.

Si dans ses prochains arrêts la Cour de Justice ne confirme pas sa jurisprudence Ferring, mais estime que les compensations de service public sont des aides d'Etat, la procédure en deux étapes proposée par la Commission dans son rapport au Conseil européen de Laeken peut être poursuivie, à savoir dans une première étape, préparation d'un encadrement communautaire, puis dans une seconde étape, à la lumière de l'expérience acquise par l'application de cet encadrement et, si et dans la mesure justifiée par l'expérience, préparation d'un règlement d'exemption exemptant certaines aides du domaine des services d'intérêt économique général de l'obligation de notification préalable.

Without prejudice to the provisions relating to the interpretation of judgments, the Court of First Instance may, of its own motion or on application by a party made within two weeks after the delivery of a judgment, rectify clerical mistakes, errors in calculation and obvious slips in it.
