The operating air carrier shall not apply the limitations set out in Article 9(4) and (5) if the passenger is a person with a disability or reduced mobility or any person accompanying him/her, an unaccompanied child, a pregnant woman or a person in need of specific medical assistance, on condition the operating air carrier or its agent or the organiser has been notified of their particular needs for assistance at least 48 hours before the scheduled time of departure of the flight. Such notification shall be deemed to cover the entire journey and the return journey if both journeys are shown on the same ticket.

According to the Advocate General, Mr Bot, the air carrier must provide care to passengers whose flights have been cancelled because of extraordinary circumstances such as the closure of airspace following the eruption of the Eyjafjallajökull volcano

According to the Advocate General, that is why the EU legislature took the view that, by contrast with the obligation for the air carrier to pay compensation – which does not apply where the air carrier proves that the cancellation of the flight was the result of extraordinary circumstances which could not have been avoided – the obligation to provide care must remain compelling, whatever the event which resulted in the cancellation and whether or not the air carrier was responsible for that event.

Every Member State shall ensure that air carriers providing services from their territory implement and maintain an air carrier security programme appropriate to meet the requirements of national civil aviation security programmes. That programme shall describe the methods and procedures which are to be followed by the air carrier in order to comply both with this Regulation and with the national civil aviation security programme of the Member State from which it provides services.

Moreover, Member States will have to perform regular inspections to verify the compliance with the proposed Regulation of air carriers using airports in their territory, or air carriers and air operators under their control (to which they have delivered an operating licence -air carriers- or an aircraft operator's certificate).
