Germany informed the Commission in the course of the formal investigation that, even though it did not explicitly admit that the notified project in Freiberg East would form a single investment project in the meaning of point 60 and footnote 55 of the RAG together with the projects in Freiberg South, Germany would limit the total aid granted for the combined eligible costs (EUR 402 865 942 in discounted value) of the three projects P2, P3 and the notified project to the maximum allowable (EUR 55 749 652 in discounted value – 14,06 % GGE) in a ‘single investment project’ scenario.

Germany also reduced the notified aid for the DS project in Freiberg East to EUR 40 364 760 (discounted value (12)), corresponding to an aid intensity of 12,97 % GGE, in order to limit the total aid granted for the combined eligible costs (EUR 402 865 942 in discounted value) of the notified project and previous projects P2 and P3 undertaken within 3 years to the maximum allowable (EUR 55 749 652 in discounted value – 14,06 % GGE) in a ‘single investment project’ scenario.
En outre, l’Allemagne a réduit l’aide notifiée pour le projet de DS à Freiberg-Est à un montant de 40 364 760 EUR [valeur actualisée (12)], soit une intensité d’aide de 12,97 % ESB, dans le but de limiter l’aide totale accordée pour couvrir les coûts éligibles (soit 402 865 942 EUR exprimés en valeur actualisée) dudit projet et des projets antérieurs P2 et P3, réalisés au cours d’une période de trois ans, au plafond maximal autorisé (soit 55 749 652 EUR en valeur actualisée ou 14,06 % ESB) pour un projet d’investissement unique.

On this basis, the Commission raised doubts against Germany’s view that the notified project did not constitute a single investment project (in the meaning of point 60 and footnote 55 of the RAG) with the project P3 in Freiberg South, and invited third parties to comment on the indivisibility of the two DS investment projects in Freiberg.
Sur cette base, elle a émis des doutes quant au point de vue de l’Allemagne selon lequel le projet notifié et le projet P3 de Freiberg sud ne constitueraient pas un projet d’investissement unique (au sens du point 60 et de la note de bas de page 55 des lignes directrices de 2007), et elle a invité les tiers intéressés à présenter leurs observations sur l’indivisibilité des deux projets de DS à Freiberg.

That is why, after it had consulted the Member States, the Commission felt it necessary to seek approval of an amendment to Regulation (EC) No 1083/2006, which is limited to Article 55(5) and relates to the following two points only: the exemption from the provisions of Article 55 of operations cofinanced by the European Social Fund and the definition of a threshold, set at EUR 1 million, below which projects financed by the ERDF or the Cohesion Fund would be exempt from the provisions of Article 55 as regards calculation of the maximum eligible expenditure and as regards monitoring.

An important difference therefore, in the new period is that, according to the definition in paragraph [...], the provisions of Article 55 apply to a broad spectrum of projects which qualify as revenue-generating projects and not just to projects to invest in infrastructure which generates large net revenue, as was the case in the 2000-2006 period.

Insists that those proposed projects and actions which have not been included in Budget 2009 due to the fact that, according to the Commission, they are already covered by an existing legal base should really be implemented under this legal base and asks the Commission to report also on those proposals within its report on the pilot projects and preparatory actions; expects the Commission to make every effort in this direction regardless of whether or not the projects and actions will eventually be explicitly mentioned in the relevant remarks of the legal bases of Budget 2009; intends to monitor closely the implementation of these projects and actions under their legal bases during the financial year 2009;

In order to prevent that a large investment project being artificially divided into sub-projects in order to escape the provisions of these guidelines, a large investment project will be considered to be a single investment project when the initial investment is undertaken in a period of three years by one or more companies and consists of fixed assets combined in an economically indivisible way (55).

To reach a balance in the budget allocation between transport and the environment in Spain over the period 1993-99, the Cohesion Fund sought to provide greater financial assistance to environmental projects so that over the period 1997-99 the breakdown would be 55% to environmental projects and 45% to transport projects (see list of projects in Annex III).
