In that regard, in so far as it refers to the findings of the administrative investigation report, which was completed after the implied decision rejecting the request for assistance took effect and in which the claims of the official concerned were examined in detail, the final decision of the appointing authority must be regarded not as a decision that merely confirms the implied decision but as a decision that replaces the latter decision following a review of the situation by the administration.
À cet égard, dans la mesure où elle se réfère aux conclusions du rapport d’enquête administrative, qui a été achevé après l’intervention de la décision implicite de rejet de la demande d’assistance et dans le cadre duquel les allégations du fonctionnaire intéressé ont été examinées en détail, la décision définitive de l’autorité investie du pouvoir de nomination doit être regardée non pas comme une décision purement confirmative de la décision implicite, mais comme une décision se substituant à cette dernière, au terme d’un réexamen de la situation par l’administration.
