Definition: This category differs from others in that it includes disorders identifiable on the basis of not only symptoms and course but also the existence of one or other of two causative influences: an exceptionally stressful life event producing an acute stress reaction, or a significant life change leading to continued unpleasant circumstances that result in an adjustment disorder. Although less severe psychosocial stress ( life events ) may precipitate the onset or contribute to the presentation of a very wide range of disorders classified elsewhere in this chapter, its etiological importance is not always clear and in each case will be found to depend on individual, often idiosyncratic, vulnerability, i.e. the life events are neither necessary nor sufficient to explain the occurrence and form of the disorder. In contrast, the disorders brought together here are thought to arise always as a direct consequence of acute severe stress or continued trauma. The stressful events or the continuing unpleasant circumstances are the primary and overriding causal factor and the disorder would not have occurred without their impact. The disorders in this section can thus be regarded as maladaptive responses to severe or continued stress, in that they interfere with successful coping mechanisms and therefore lead to problems of social functioning.

(2) Notwithstanding subsection (1), any person described in paragraph 26(m) of the Act to whom a pension under Part II or III of the former Act is payable may, within one year of becoming a contributor under Part I of the Act, elect to surrender the original pension, whereupon the contributor shall be deemed, for the purposes of the Act, to be a person by whom an election under subsection 18(2) of the Royal Canadian Mounted Police Superannuation Act, c. R-11 of the Revised Statutes of Canada, 1970 was made at the time of the surrender of the original pension, in all respects as though the contributor were a person described in subsection 18(2) of the Royal Canadian Mounted Police Superannuation Act, c. R-11 of the Revised Statutes of Canada, 1970, except that if, upon subsequently ceasing to be a member of the Force, the contributor is entitled under Part I of the Act to an annuity or annual allowance the capitalized value of which is less than the capitalized value of the original pension, in lieu of any other benefit under Part I of the Act whatever right or claim that, but for this subsection, the contributor would have had to the original pension upon subsequently ceasing to be a member of the Force shall thereupon be restored to the contributor, and there shall be paid to the contributor an amount equal to his contributions under Part I of the Act made in respect of his augmenting service.

(2) The amount of the annuity or annual allowance to which a contributor described in subsection 13(6) or section 23 of the Act may become entitled under Part I of the Act shall not be less than the annual allowance that the contributor was receiving before the contributor’s latest re-employment in the Public Service, plus any increase therein to which the contributor would be entitled in respect of the period of pensionable service to the contributor’s credit as a result of the contributor being so re-employed.

and the deputy head of the employing department certifies to the Minister that the contributor is on leave without pay for that reason, the contributor shall pay into the Superannuation Account, in respect of any portion of the period of absence that falls within the 52 week period following the day of birth of a child of the contributor or the day of adoption of a child by the contributor, the amount that the contributor would have had to pay pursuant to sections 5 and 65 of the Act had the contributor not been absent.
