Therefore, in order to be justified with regard to the fundamental principle of the free movement of goods within the internal market, a mandatory prior authorisation procedure should pursue a public-interest objective recognised by Community law, and should be non-discriminatory and proportionate; that is to say, it should be appropriate to ensure achievement of the aim pursued but not go beyond what is necessary in order to achieve that aim.
Par conséquent, pour qu'une procédure d'autorisation préalable soit justifiée au regard du principe fondamental de la libre circulation des marchandises sur le marché intérieur, elle devrait répondre à un objectif d'intérêt public reconnu par le droit communautaire et être non discriminatoire et proportionnée, autrement dit, être de nature à permettre la réalisation de l'objectif poursuivi mais ne pas aller au-delà de ce qui est nécessaire pour atteindre ledit objectif.
