In order not to jeopardize the possible privatization of the shares of Bavaria in NMH and LSW after the expected annulment of the Commission's decision, the German authorities requested the Commission, if it were to conclude that the loans represented State aid, to postpone its decision on the recovery of these loans until after the final decision of the Court of Justice.
Afin de ne pas mettre en péril la cession éventuelle des parts détenues par le Land de Bavière dans NMH et LSW après l'annulation attendue de la décision de la Commission, le gouvernement allemand a demandé à la Commission que, au cas où elle considérerait définitivement les prêts comme des aides d'État, elle suspende sa décision demandant leur remboursement jusqu'à ce que la Cour de justice ait rendu un arrêt définitif.
