Is equally concerned at the recent statement by the French Defence Minister, Jean-Yves Le Drian, regarding the need to operate militarily in Libyan coastal waters in order to effectively fight human smugglers and traffickers; stresses the many negative statements by Libyan decision-makers with regard to the plans to deploy EUNAVFOR Sophia forces in Libyan territorial waters; recalls that without the consent of the Libyan authorities or a UN mandate under Chapter VII of the UN Charter, such military action is to be considered illegal and an act of aggression; is concerned about the overall effectiveness of the approach, in light of recent experiences onshore in the context of EUNAVFOR Atalanta in Somalia, the possible collateral damage and causing of suffering to the coastal population, and the fact that such inappropriate and illegal military action by EU Member States might result in strengthening support for violent extremists like IS;
8. se dit également préoccupé par la récente déclaration du ministre français de la défense, Jean-Yves Le Drian, sur la nécessité d'une opération militaire dans les eaux côtières libyennes afin de lutter effectivement contre les trafiquants d'êtres humains et les passeurs; met l'accent sur les nombreux commentaires négatifs de décideurs politiques libyens au sujet des projets de déploiement de l'EU NAVFOR MED, opération SOPHIA, dans les eaux territoriales libyennes; rappelle que, sans le consentement des autorités libyennes ni mandat au titre du chapitre VII de la charte des Nations unies, une telle action militaire doit être considérée comme illégale et comme un acte d'agression; est préoccupé par l'efficacité globale de l'approche, compte tenu des récentes expériences à terre dans le contexte de l'opération EUNAVFOR Atalanta en Somalie, par le risque de provoquer des dommages collatéraux et d'infliger des souffrances à la population côtière et par le fait qu'une telle action militaire illégale et inappropriée menée par des États membres de l'Union pourrait renforcer le soutien dont bénéficient des groupes extrémistes violents tels que l'EI;

However, once the French Republic intervened in proceedings before the General Court, it follows from the second paragraph of Article 56 of the Statute of the Court of Justice that that Member State may bring an appeal even when the General Court’s decision does not directly affect it.

The French Republic still maintains that there were valid reasons for the inclusion by the contested decision of the PMOI’s name in the list referred to in Article 2(3) of Regulation No 2580/2001, and it has argued before the Court that it retains an interest in having the errors made by the General Court in the judgment under appeal recognised by the Court, in order that it may request the Council to include the PMOI in that list once more.
