34. Underlines that, as confirmed by the Legal Service in its Opinion of 29 February 2012, the fields of activity of the European Union institutions, as contained in the Treaty, are wider than the mere sum of the competences exercised by the Union; takes into account the view of Parliament’s Legal Service that Parliament is entitled to adopt internal administrative decisions which aim to establish a procedure for the processing of submissions from citizens; regrets in this respect the failure of the appropriate Parliament service to follow through on Parliament’s Resolution of 21 November 2012 on the activities of the Committee on Petitions 2011,with regard to submissions from citizens on issues which fall outside the EU’s area of competence; takes note, finally, of the legal ruling by the Court of Justice of the European Union (Case T-280/09), specifying that a petition must be drafted in a sufficiently clear and precise manner so as to be properly understood, in light of the conditions set out in Article 227 TFEU;

On the legal basis provided by Article 34(2) of the EU Treaty, Parliament has repeatedly called for the Europol Convention to be amended by means of the new mechanisms mentioned above. Hence the rapporteur takes a highly favourable view of the proposal for a Council decision by means of which the European Police Office will be set up and which will replace and derogate from the Europol Convention and the three protocols thereto.
Le Parlement européen a demandé plusieurs fois la modification de la convention Europol au travers des nouveaux mécanismes susmentionnés sur la base de l'article 34, paragraphe 2, du traité UE. Partant, le rapporteur accueille très favorablement la proposition de décision du Conseil portant création d'un Office européen de police qui remplacera et dérogera à la convention Europol et ses trois protocoles.

4. The Council, either on a proposal from the Commission and after consulting the European Parliament and the European Central Bank or on a recommendation from the European Central Bank and after consulting the European Parliament and the Commission, shall adopt the provisions referred to in Articles 4, 5.4, 19.2, 20, 28.1, 29.2, 30.4 and 34.3 of the Statute of the ESCB and of the ECB.

Notes that levels of sub-titling and sign language interpretation and presentation of programmes in sign language for those with hearing difficulties, and of audiovisual description for the visually impaired, vary quite widely from Member State to Member State; recalls the Commission's commitment to the European Parliament in June 2002 to raise this issue in the present report; notes that the Commission has not done so; calls once again on the Commission to address the problem of improving access to the broadcast media for those suffering from sensory impairment; calls on the Commission, in its work programme, to include an annual benchmarking report on the progress in all Member States on making digital TV accessible for people with disabilities; believes that this report should be based on National Action Plans on 'Improving disabled people's access to digital TV' submitted to the Commission by each of the Member States;
34. note que l'importance du sous-titrage et de l'interprétation en langue des signes, ainsi que la présentation des émissions en langue des signes pour les personnes souffrant de déficiences auditives et en audiovision pour les handicapés visuels, varie assez considérablement entre les États membres; rappelle que la Commission s'est engagée en juin 2002 devant le Parlement européen à évoquer cette question dans le présent rapport; note qu'elle ne l'a pas fait et demande une fois de plus à la Commission de se pencher sur le problème de l'amélioration de l'accès aux médias diffusés pour les personnes souffrant de handicaps sensoriels; estime que dans son programme de travail, la Commission devrait prévoir un rapport d'étape annuel sur les progrès réalisés dans les divers États membres en matière d'accessibilité de la télévision numérique aux personnes handicapées et que ce rapport devrait se fonder sur les plans d'action nationaux sur l'amélioration de l'accès des personnes handicapées à la télévision numérique que les États membres doivent transmettre à la Commission;

The amendments to the international instruments referred to in Article 1 may be excluded from the scope of this Directive, pursuant to Article 5 of Regulation (EC) No 2099/2002 of the European Parliament and of the Council of 5 November 2002 establishing a Committee on Safe Seas and the Prevention of Pollution from Ships (COSS)(34)".

Les modifications des instruments internationaux visés à l'article 1er peuvent être exclues du champ d'application de la présente directive en application de l'article 5 du règlement (CE) n° 2099/2002 du Parlement européen et du Conseil du 5 novembre 2002, instituant un comité pour la sécurité maritime et la prévention de la pollution par les navires (COSS)(34)".
