As for the procedures to obtain compensation, many Member States (BG, CZ, ES, IE, LTMT, NL, PT and SE) provide for a dual system whereby the victim can bring a civil action for compensation against the perpetrator within the criminal procedure; if the victim is not fully compensated through this procedure, there is still a possibility to receive compensation from the State.

2. The compensation body which has compensated the injured party in his Member State of residence shall be entitled to claim reimbursement of the sum paid by way of compensation from the compensation body in the Member State in which the insurance undertaking which issued the policy is established.

It follows from Article 3 read in conjunction with Article 4(2) of the VAT Compensation Act, that the Norwegian State compensates input tax paid by taxable persons covered by the VAT Compensation Act when buying goods and services from other taxable persons when they do not have the right to deduct input tax since they are tax exempted according to the VAT Act (15).

(3) In accordance with the provisions of Article 6(2) of the fourth Directive, the compensation body of a Member State which has compensated an injured party residing in that Member State shall be entitled to claim reimbursement of the sum paid by way of compensation from the compensation body in the Member State in which the insurance undertaking which issued the policy of the presumed liable party is established.

This Directive provides that certain categories of professional and institutional investor can be exempted from the scope of mandatory investor protection schemes provided for in the Directive (Article 4(2)) "if it does not consider that they need special protection from the cover afforded by investor-compensation schemes" (recital 17).The Investor Compensation Scheme Directive clearly revolves around the "need for protection" philosophy.
