‘2. Temporary Judges shall be appointed, in addition to the Judges referred to in the first subparagraph of paragraph 1, in order to take the place of those Judges who, while not suffering from disablement deemed to be total, are prevented from participating in judicial business for an extended period of time’.

Another judge from a higher German court in a border area commented that the level of knowledge of Community law varied very widely among parties. This was the main factor determining the frequency with which Community law was raised.

KLE submits in the reply that the members of the Court of First Instance did not have personal knowledge of all the documents in the case, but knew them only via the summary, much compressed and sometimes confused, made by the Judge-Rapporteur in the Report for the Hearing.
