TRADUCTIONS EN CONTEXTE

Regrets that little progress has been made to implement Regulation (EC) No 1049/2001 as regards the obligation for the institutions, agencies and other bodies to keep complete registers of documents, as provided for in its Articles 11 and 12 and, ultimately, in the Lisbon Treaty and the Charter of Fundamental Rights; calls for a common approach on registers to be established, and calls on those EU institutions that have not yet established registers of documents to do so, and to implement measures to standardise the classification and presentation of the institutions’ documents; reiterates, in this regard, further to a common access point to EU documents through the three institutions’ portals, its call for common procedures and criteria for registration and the assignment of an interinstitutional code to each document so that, eventually, a common interinstitutional register, including a dedicated joint database on the state of play of legislative files, could be established.

Urges all institutions, pending its desired revision, to apply Regulation (EC) No 1049/2001, and the subsequent jurisprudence, fully and to the letter and spirit, and to take into account the changes brought about by the Lisbon Treaty and the Charter of Fundamental Rights; calls, in particular, on the Council, including its preparatory bodies, to publish minutes of the meetings of Council working groups and other documents, in the light of the Access Info Europe case, intervening Member States and their proposals; calls on Parliament to make available the agendas and feedback notes of the meetings of Committee coordinators, the Bureau and the Conference of Presidents, as well as, in principle, all documents referred to in these agendas, in accordance with the provisions of Regulation (EC) No 1049/2001, by publishing them on the Parliament’s website.

This situation was identified by the European Council in the Stockholm Programme, which calls on the EU institutions and Member States to ensure that legal initiatives remain consistent with fundamental rights " throughout the legislative process by way of strengthening the application of the methodology for a systematic and rigorous monitoring of compliance with the Convention and the rights set out in the Charter of Fundamental Rights "[17].
Cette situation a été identifiée par le Conseil européen dans le Programme de Stockholm qui invite les institutions de l'UE et les États membres à veiller à ce que les initiatives juridiques restent conformes aux droits fondamentaux « tout au long du processus législatif, en renforçant l'application des méthodes employées pour vérifier de manière systématique et rigoureuse que la convention et les droits énoncés dans la Charte des droits fondamentaux sont bien respectés »[17].

39. Stresses the importance of respecting and protecting the rights of refugees and migrants, and underlines the fact that special attention should be paid to women and children migrants; expresses its concern about the numerous breaches of the right to asylum and of the obligation to ensure protection in the event of removal, expulsion and extradition of any migrant; stresses the obligation to comply with international human rights conventions, particularly the UN Convention relating to the Status of Refugees and the principle of non-refoulement, and the obligation to come to the assistance of people at sea who are risking their lives to reach the EU, and to arrange for reception conditions and procedures which respect their dignity and fundamental rights; calls on the EU and the Member States to amend or review any legislation sanctioning people assisting migrants in distress at sea; calls on the Commission to review Council Directive 2002/90/EC defining the sanctions in case of facilitation of unauthorised entry, transit and residence in order to clarify that providing humanitarian assistance to migrants at sea who are in distress is to be welcomed and not an action which should ever lead to any form of sanctions;
39. souligne l'importance de respecter et de protéger les droits des réfugiés et des migrants et ajoute qu'une attention spéciale devrait être accordée à la situation des femmes et des enfants migrants; s'inquiète des nombreux cas de violation du droit d'asile et de l'obligation de protection en cas d'éloignement, d'expulsion et d'extradition de migrants; souligne l’obligation de respecter les conventions internationales relatives aux droits humains, en particulier la convention des Nations unies relative au statut des réfugiés et le principe de non-refoulement, de porter secours aux personnes en mer qui risquent leur vie pour rejoindre l’Union européenne, et de mettre en place des conditions d'accueil et des procédures dignes et respectueuses des droits fondamentaux des personnes; demande à l'Union et aux États membres de modifier ou de réviser toute législation prévoyant des sanctions à l'encontre des personnes qui portent secours aux migrants en détresse en mer; demande à la Commission de réviser la directive 2002/90/CE du Conseil définissant les sanctions appliquées en cas d'aide à l'entrée, au transit et au séjour irréguliers, dans le but de préciser que l'aide humanitaire apportée en mer aux migrants en détresse constitue la règle et non une action susceptible d'être jamais soumise à la moindre sanction;

Bearing in mind that the majority of the crew on many non-Community flagged vessels calling at European ports are Filipino, as well as the harsh and inhuman working conditions in which many of these seafarers live, calls on Member States not to allow these vessels to be received in European ports when the working conditions on board contravene the labour rights and principles enshrined in the Charter of Fundamental Rights of the European Union; urges, likewise, non-Community flagged vessels to guarantee their crews’ working conditions in accordance with international legislation and the rules laid down by the ILO and the IMO.

159. Calls on the Commission, in the light of its evaluation of European Readmission Agreements (EURAs), to refrain from supporting the hasty conclusion of new agreements that lead to violations of fundamental rights; calls on the Council to observe the ‘no agreement at any cost’ principle;

47. Points out that the Paris Principles on NHRIs should be used as a model for reforming the national institutions and the FRA, and calls on the Commission and the Council , together with the European Parliament, to revise, as a matter of urgency, the founding regulation of the FRA under the ordinary legislative procedure, so that the remit of the FRA is broadened to cover the full scope of Articles 2, 6 and 7 of the TEU and, in particular, the European Charter’s implementation by the EU institutions, agencies, offices and bodies, as well the activities of Member States; considers that the independence of the FRA should be strengthened, as well as its powers and competences; considers that the FRA Scientific Committee and the FRANET network should submit to the European Parliament and the national parliaments and publish annually a thematic and more focused report assessing the situation in the Member States, as was done until 2006 by the former Network of Experts on Fundamental Rights; calls on the FRA to fully respect Article 15 of the TFEU by making its proceedings open and by giving access to its documents via a publicly accessible register, as foreseen by Regulation (EC) No 1049/2001;
47. souligne que les principes de Paris sur les institutions nationales pour les droits de l’homme devraient servir de modèle pour réformer les institutions nationales ainsi que l’Agence des droits fondamentaux; invite la Commission et le Conseil à réviser d’urgence, avec lui, le règlement instituant l’Agence des droits fondamentaux, selon la procédure législative ordinaire, de façon à élargir son mandat pour couvrir la totalité du champ d’application des articles 2, 6 et 7 du traité UE, notamment la mise en œuvre de la Charte par les instituions, les agences, les offices et les organes de l’Union, ainsi que les activités des États membres; estime qu’il convient de renforcer l’indépendance de l’Agence des droits fondamentaux, de même que ses pouvoirs et ses compétences; estime que le comité scientifique de l’agence ainsi que le réseau FRANET devrait lui soumettre, ainsi qu’aux parlements nationaux, et publier chaque année, un rapport thématique et plus précis analysant la situation dans les États membres, comme le faisait jusqu’en 2006, l’ancien réseau des experts sur les droits fondamentaux; demande à l’Agence des droits fondamentaux de respecter scrupuleusement l’article 15 du traité FUE en rendant publiques ses délibérations et en donnant accès à ses documents via un registre accessible au public, comme le prévoit le règlement (CE) n 1049/2001;

31. Calls on the Commission to adopt a more ambitious and concrete strategy for the protection of fundamental rights in the Union and in Member States as well as candidate states by strengthening the capabilities for monitoring, blocking and sanctioning violations of fundamental rights; calls for the strengthening and enlargement of the mandate of the Fundamental Rights Agency and encourages the establishment of a European Ombudsman for the freedom of speech and the media; calls on the Commission to engage more actively in combating rising racism and xenophobia by all means, in particular by developing and enforcing a comprehensive legislative framework, while respecting the diversity of Member States; invites the Commission to take initiatives to guarantee media freedom and pluralism; urges the Commission to bring to Court Member States that violate the free movement and anti-discrimination directives; calls for a strong European Roma Strategy, for the anticipation of the foreseen initiatives on mutual recognition of civil documents, and for an EU roadmap against homophobia and for LGBT rights;
31. demande à la Commission d'adopter une stratégie plus ambitieuse et plus concrète en termes de protection des droits fondamentaux dans l'Union, dans les États membres ainsi que dans les pays candidats, en renforçant les capacités de surveillance, de blocage et de sanction en cas de violation des droits fondamentaux; demande de renforcer et d'élargir le mandat de l'Agence des droits fondamentaux et encourage la mise en place d'un médiateur européen chargé de la liberté d'expression et des médias; prie la Commission de se consacrer davantage à lutter par tous les moyens contre le racisme et la xénophobie, qui sont en progression, notamment en développant et en appliquant un cadre législatif exhaustif, tout en respectant la diversité des États membres; encourage la Commission à prendre des initiatives garantissant la liberté et le pluralisme des médias; invite instamment la Commission à saisir la Cour de toute violation, par les États membres, des directives relatives à la libre circulation et la lutte contre les discriminations; appelle de ses vœux une stratégie européenne forte en faveur des Roms, l'anticipation des initiatives prévues en matière de reconnaissance mutuelle des actes civils ainsi qu'une feuille de route européenne pour lutter contre l'homophobie et promouvoir les droits des populations LGBT;

7. Stresses that genuinely systematic and rigorous protection of fundamental rights calls not only for scrutiny to identify any legal errors in weighing up the respective importance of the freedom of the individual and the requirements of the public interest, butalso for political analysis on every occasion to ascertain which of the various solutions that weigh up these interests correctly produces the best balance between determination of the objective and restriction of fundamental rights (optimisation in terms of fundamental rights);
7. souligne qu'un contrôle réellement systématique et rigoureux du respect des droits fondamentaux ne consiste pas uniquement à rechercher d'éventuelles erreurs de droit lorsque sont mis en balance la liberté individuelle et les exigences de l'intérêt général, mais nécessite aussi dans chaque cas une analyse politique afin d'identifier, parmi les diverses solutions assurant une juste pondération de ces intérêts, celle qui présente le meilleur équilibre entre l'objectif poursuivi et la limitation des droits fondamentaux (optimisation en termes de droits fondamentaux);
