The EU Agency for Fundamental Rights is currently working on monitoring social inclusion and the participation of migrants and their descendants in society from a fundamental rights perspective and will publish in 2017 the results of the second wave of the largest EU wide survey on experiences of discrimination, hate crime victimisation and societal participation of migrants and minorities (EU-MIDIS II).

Mr. John Maloney (Erie—Lincoln, Lib.): Mr. Speaker, the second pair of petitions from my riding of Erie—Lincoln is from petitioners who implore this government to enact legislation to authorize a proclamation to be issued by the governor general under the great seal of Canada amending section 7 of the Canadian Charter of Rights and Freedoms to recognize the fundamental right of individuals to pursue family life free from undue interference by the state and to recognize the fundamental right and responsibility of parents to direct the upbringing of their children.

Mr. Werner Schmidt (Kelowna, Ref.): Mr. Speaker, the second petition asks that the Government of Canada amend section 7 of the Canadian Charter of Rights and Freedoms to (a) recognize the fundamental rights of individuals to pursue family life free from undue interference of the state and (b) to recognize the fundamental right, responsibility and liberty of parents to direct the upbringing of their children, and that we urge the legislative assemblies of the provinces to do likewise.

This obligation to exercise the right to assume responsibility arises, in the view of Advocate General Trstenjak, first, from the obligation on Member States to apply Regulation No 343/2003 in a manner which respects fundamental rights. Second, the obligation arises from the fact that the transfer of asylum seekers to a Member State in which there is a serious risk that the fundamental rights guaranteed to them under the Charter of Fundamental Rights may not be respected also constitutes, in principle, a breach of those fundamental rights on the part of the transferring Member State.

Second report by a group of independent experts on the protection of fundamental rights in the Union The network of independent experts on fundamental rights, set up by the Commission at the request of the European Parliament in 2002, has just presented its report for 2003 to Mr António Vitorino, the Commissioner responsible for Justice and Home Affairs. For the first time, the report covers the 25 Member States of the European Union.
