While in its judgements the Court was called to focus specifically on the respect of the fundamental right of defence and in particular on the right to be heard, the case law in this area has broader consequences and could be summarised as follows: the EU standards of protection of fundamental rights should be respected irrespective of whether restrictive measures are adopted at EU level or stem from international organisations such as the United Nations (2).
