A. whereas the future Association Agreement with Ukraine heralds a new generation of association agreements under Article 217 TFEU and involves an unprecedented level of integration between the EU and a third country; whereas, with this agreement, Ukraine is committing itself to implement a large portion of the acquis communautaire; whereas the negotiations with Ukraine are among the most advanced in the Eastern Neighbourhood and therefore serve as an example for the European Neighbourhood Policy (ENP) as a whole;

(s) provide in the negotiating guidelines for gradual reciprocal trade liberalisation under competitive conditions, so as to ensure that the future agreement reduces existing imbalances between the EU and the CAN, and among the CAN countries; provide therefore for special, variable and flexible treatment, following an agreed timetable, depending on commitments on regional integration and improved competitiveness achieved by the Andean countries, proceeding from the premiss that transformation of the production sector and the competitiveness of the Andean economies need to be strongly supported under development cooperation measures and through technology transfer, the inclusion of requirements for home-country content in rules of origin, and the establishment of cooperation and technical assistance programmes; all of which should go hand in hand both with a stable legal environment which guarantees safety for investments and the parties’ economic and trade relations and with an approach seeking to foster competitiveness and the free market under a liberalisation policy consistent with the aims of the future association agreement;
s) prévoir, dans lesdites directives, la libéralisation progressive et réciproque des échanges commerciaux dans des conditions compétitives, afin que le futur accord réduise les asymétries existant entre l'Union européenne et la CAN, ainsi qu'entre les pays de cette dernière; prévoir en conséquence un traitement spécial, différencié et souple pour ce qui est des délais à accorder, en fonction des engagements dans le domaine de l'intégration régionale et des progrès accomplis par les pays andins en matière de compétitivité; il est nécessaire de soutenir sans faille la transformation de la production et la compétitivité des économies andines par le biais d'instruments de coopération au développement et de transferts de technologies, d'ajout de critères à contenu national dans les règles d'origine et de création de programmes de coopération et d'assistance technique, toutes mesures visant à promouvoir un environnement juridique stable qui garantissent la sécurité des investissements et des relations économiques et commerciales entre les parties; assurer la compétitivité et la liberté du marché grâce une politique de libéralisation qui soit cohérente avec les objectifs du futur accord d'association;

These obligations are the reason why the future Association Agreement should be more than merely a trade agreement.
