Rejects the draft memorandum of understanding in which a code of practice for the exchange of information between OLAF and the Commission is set out, because it impinges upon the Regulation currently in force and, therefore, on OLAF's remit; believes that the provisions governing the forwarding of information should perhaps be reviewed in the context of a revised regulation; insists that the notification of OLAF should be enshrined in the Statute pursuant to Article 2 of the standard decision; insists that the head of OLAF should determine the content of the information, taking as criteria the protection of the rights of the person concerned, the need for an effective and efficient investigation to be carried out and the need for the EU institutions to be protected against any financial loss in future; calls on the Commission and OLAF to check whether it would be worthwhile to create the post of a legal officer; considers that each EU institution should lay down rules governing the way in which it deals with information received from OLAF, ensuring that it respects these criteria;

43. When consideration is given to the future guidelines for the rules governing the next programming period, more ambitious financial equalisation measures should perhaps be proposed with a view to achieving more effective wealth redistribution among Member States at a lower cost in terms of programming, management, monitoring and assessment, in keeping with the principle of subsidiarity and the arrangements which some Member States already employ vis-à-vis their own regional or local authorities.
43. On peut se demander si, dans le cadre des réflexions relatives aux orientations futures de la réglementation de la prochaine période de programmation, des mesures de péréquation financière plus ambitieuses ne devraient pas être proposées pour assurer, avec une plus grande efficacité, une meilleure redistribution entre Etats membres à un coût de programmation, de gestion, de contrôle et d'évaluation moins élevé, dans le respect du principe de subsidiarité et à l'instar de ce que certains Etats membres pratiquent déjà vis-à- vis de leurs propres collectivités régionales ou locales.
