On 19 April 2016, the Committee on Economic and Monetary Affairs of the European Parliament and the Commission's Competition Directorate General co-organised a Public Hearing on how to empower national competition authorities to be more effective enforcers.
Le 19 avril 2016, la commission des affaires économiques et monétaires du Parlement européen et la direction générale de la concurrence de la Commission européenne ont organisé conjointement une audition publique sur les mesures à prendre pour doter les autorités nationales de concurrence des moyens de mettre en œuvre plus efficacement les règles européennes de concurrence.

The appointing authority has a broad discretion when determining the criteria of the abilities required for posts to be filled and when determining, according to those criteria and, more generally, in the interest of the service, the conditions and procedures for the organisation of a competition, in the light of the purpose of any competition organised within the European Union, which, as is clear from the first paragraph of Article 27 of the Staff Regulations, is to secure for the institution, as for any body, the services of officials of the highest standard of ability, efficiency and integrity.

5. Notes the Commission's first biennial report on the situation of social services of general interest in the EU; insists that the issue of services of general interest is another important point as regards the revision of the Treaties; in this connection, emphasises the need for clear provisions in EU primary law to ensure that public goods, public services, services of general interest and the non-profit sector are not subject to the rules on competition, state aid, public procurement and the internal market, but form a sector which is guided solely by the public interest and which is organised according to the principle of subsidiarity within the sole competency of the Member States and their respective regional and local authorities to ensure their proper functioning;

It deals with globalisation and liberalisation, raising the question of whether a general legislative framework should be established at Community level for services of general interest, and seeks to deal with these issues by asking questions about: the impact of any additional Community initiatives to implement the treaty, in full respect of the principle of subsidiarity; the principles likely to be incorporated in any framework legislation on services of general interest and the actual added value of legislation of that kind; the definition of good governance in the organisation, regulation, funding and evaluation of services of general interest; an examination of any new measure likely to be taken to increase legal certainty and facilitate consistent, harmonious coordination between the objective of safeguarding high-quality services of general interest and the rigorous application of the competition and internal market rules.
Dans ce contexte, le livre vert tient également compte de la mondialisation et de la libéralisation et soulève aussi la question de savoir s'il convient de créer un cadre juridique général au niveau communautaire pour les services d'intérêt général. 26. Calls in this connection, and in the interests of possible improvements in efficiency through the involvement of new operators and ways of providing SGIs, for more legal certainty as a matter of urgency as regards the different forms of inter-authority organisations (cooperation between local authorities, public-private partnership, awarding concessions) and the clarification of European law on competition the award of contracts and State aid and of the general criteria applicable throughout Europe; stresses that there should be legal clarification concerning the outsourcing of public services, which is distinct from the award of public contracts; calls on the Commission to spell out the rules for awarding such outsourced services and to make a clear distinction between those rules and the rules governing public contracts;
26. demande dans ce contexte, et dans l'intérêt d'éventuels gains d'efficacité résultant de la mise en jeu de nouveaux opérateurs et de nouvelles formes de fourniture de SIG, de garantir d'urgence plus de sécurité juridique pour les différentes formes d'organisations associant plusieurs autorités (coopération intercommunale, partenariat public-privé, octroi de concessions), ainsi que de clarifier le droit européen en matière de concurrence, de passation de marché et d'aides d'État et des critères d'application générale valables à l'échelle de l'Europe; souligne que les externalisations de service public, qui ne sont pas de la même nature que l'octroi de marchés publics, devraient faire l'objet d'une clarification juridique; demande à la Commission de préciser les règles d'attribution de services ainsi externalisés en les distinguant sans équivoque de celles des marchés publics;

16. Regards the distinction between services of general interest and services of general economic interest as irrelevant for the purpose of striking a balance between general interest activities and competition law: for example, this distinction is often difficult to apply in the social services sector which requires special treatment , as a large number of social services, or some of the activities of service providers may be regarded as being economic in nature and stresses the great diversity of the various methods of organising SGIs (for example, the co-existence of direct public management and private management in the public-service broadcasting sector helps safeguard media pluralism, democracy and cultural diversity; by the same token, the legislation should take account of the specific characteristics of non-profit making charitable, cultural or social associations); urges the Commission, therefore, not to base its policy on SIGs on that distinction, and to give further thought to a classification taking particular account of the nature of the activities and the geographical area in which they are carried out, including the European area;

Requests all institutions to inform the budgetary authority of their building needs and possible building projects in the context of the annual report of the Secretaries-General on the evolution of heading 5; points out that the annual report should also include an assessment concerning the pensions of staff, particularly the current and future adequacy of funding; requests all Secretaries-General also, in the same context, to inform the budgetary authority about the functioning of the European Personnel Selection Office (EPSO), the organisation of open competitions and the way the specific needs of the various institutions are taken into account; also invites the Secretaries-General to provide information on the state of affairs and perspectives for facilitating tele-working in the institutions;
