- In the aftermath of the collapse of Lehman Brothers in fall 2008, I coordi-nated, together with Jens Weidmann, who at that time was at the Chancel-lor’s office, the German government’s response to the financial crisis, in-cluding inter alia stabilizing the bank Hypo Real Estate (HRE), drafting the law on financial market stabilisation, setting up the Financial Markets Stabi-lisation Fund and – later – agency (SoFFin/FMSA) and becoming Chairman of its inter-ministerial steering committee.

The German Government’s draft ‘Steuervergünstigungsabbaugesetz’ discriminates against foreign-domiciled investment funds by subjecting them to capital gains tax at double the domestic-domiciled level. The proposal would impose a 15% capital gains tax on foreign funds, in contrast to a 7.5% charge on domestic funds.
Le projet de loi du gouvernement allemand visant à abolir les privilèges fiscaux instaure une discrimination à l'encontre des fonds de placement étrangers, qui seraient assujettis à un impôt sur les plus-values de capitaux d'un montant deux fois supérieur à celui qui frappe les fonds de placement des résidents. Cette proposition reviendrait à imposer à 15 % les plus-values de capitaux sur les fonds des non-résidents, contre 7,5 % sur les fonds des résidents.

The German government adopted on 22 February a draft federal budget for 2006 and a draft law aimed at raising the standard VAT rate from 16% to 19% as from 1 January 2007.

The Commission has been informed that the German Government intends to present new legislation on the taxation of investment funds in general to apply as from January 2004, but no draft legislation had been published so far.

Furthermore, the current level of the penalties is disproportionate to construction firms that are not covered by Germany's provisions on minimum wages and paid leave - i.e. particularly SMEs (and firms in the prefabricated housing sector that are threatened by temporary disqualification from public contracts). The Commission notes that, as long ago as 1999, the German Government had announced its intention to amend the provisions in question but has omitted to send the Commission a draft text or legislative timetable.
En outre, le niveau des sanctions actuelles est disproportionné par rapport aux entreprises du bâtiment qui ne relèvent pas du régime allemand sur le salaire minimum et les congés payés, à savoir notamment les PME (et les entreprises dans le secteur des maisons préfabriquées qui se voient affectées et menacées d'une exclusion temporaire des marchés publics. La Commission constate que le gouvernement allemand avait annoncé dès 1999 son intention de modifier les dispositions incriminées mais qu'il a omis de communiquer à la Commission un projet de texte ou un calendrier législatif.

Following this judgement, the German Government instructed the competent authorities to stop applying this provision, but the Commission received no draft amendment aimed at bringing the law into line with the ruling of the Court.
Suite à cet arrêt, le gouvernement allemand a donné des instructions aux autorités compétentes de ne plus appliquer cette disposition, mais aucun projet de texte visant à modifier la loi afin de la mettre en conformité avec l'arrêt de la Cour, ni calendrier législatif, n'ont été communiqués à la Commission.
