TRADUCTIONS EN CONTEXTE

Whereas according to different artistic traditions within the Community water-colour, gouache and pastel pictures are variously regarded as being either paintings or drawings; whereas category 4 of the Annex to Regulation No 3911/92 (4) includes drawings executed entirely by hand on any medium in any material and category 3 includes pictures and paintings executed entirely by hand on any medium in any material; whereas the financial thresholds which apply to these two categories are different; whereas in the internal market this could lead to serious differences of treatment for water-colour, gouache and pastel pictures depending upon the Member State in which they are situated; whereas it is necessary to decide for the purposes of the application of the Regulation into which category they shall fall to ensure that the financial thresholds applied shall be the same throughout the Community;
considérant que, selon les différentes traditions artistiques dans la Communauté, les tableaux réalisés à l'aide de couleur à l'eau, de gouache et de pastel sont considérés soit comme des peintures, soit comme des dessins; que, de la catégorie 4 de l'annexe du règlement (CEE) n° 3911/92 (4), relèvent les dessins faits entièrement à la main, sur tout support et en toutes matières et que, de la catégorie 3, relèvent les tableaux et les peintures faits entièrement à la main, sur tout support et en toutes matières; que les seuils de valeur s'appliquant à ces deux catégories sont différents; que, dans le cadre du marché intérieur, ceci pourrait donner lieu à de sérieuses différences de traitement des tableaux réalisés à l'aide de couleur à l'eau, de gouache et de pastel selon l'État membre où ils se trouvent; qu'il est nécessaire, aux fins de l'application du règlement, de décider de quelle catégorie ils relèvent pour garantir une application uniforme des seuils de valeur dans la Communauté;

Whereas according to different artistic traditions within the Community water-colour, gouache and pastel pictures are variously regarded as being either paintings or drawings; whereas Category 4 of the Annex to Directive No 93/7/EEC (4) includes drawings executed entirely by hand on any medium in any material, and Category 3 includes pictures and paintings executed entirely by hand on any medium in any material; whereas the financial thresholds which apply to these two categories are different; whereas in the internal market this could lead to serious differences of treatment for water-colour, gouache and pastel pictures depending upon the Member State in which they are situated; whereas it is necessary to decide for the purposes of the application of the Directive into which category they shall fall to ensure that the financial thresholds applied shall be the same throughout the Community;
considérant que, selon les différentes traditions artistiques dans la Communauté, les tableaux réalisés à l'aide de couleur à l'eau, de gouache et de pastel sont considérés soit comme des peintures, soit comme des dessins; que, de la catégorie 4 de l'annexe de la directive 93/7/CEE (4), relèvent les dessins faits entièrement à la main, sur tout support et en toutes matières et que, de la catégorie 3, relèvent les tableaux et peintures faits entièrement à la main, sur tout support et en toutes matières; que les seuils de valeur s'appliquant à ces deux catégories sont différents; que, dans le cadre du marché intérieur, ceci pourrait donner lieu à de sérieuses différences de traitement des tableaux réalisés à l'aide de couleur à l'eau, de gouache et de pastel selon l'État membre où ils se trouvent; qu'il est nécessaire, aux fins de l'application de la directive, de décider de quelle catégorie ils relèvent pour garantir une application uniforme des seuils de valeur dans la Communauté;

Whereas experience shows that the prices realized by water-colour, gouache and pastel pictures tend to be rather higher than those realized by drawings and much lower than those fetched by paintings in oil or tempera; whereas accordingly it is expedient to place water-colour, gouache and pastel pictures into a new separate category with a threshold of ECU 30 000 which would ensure that works of major significance would require an export licence while there would not be the creation of any undue administrative load placed upon the licensing authorities,
considérant que l'expérience montre que les tableaux réalisés à l'aide de couleur à l'eau, de gouache et de pastel atteignent un niveau de prix plutôt plus élevé que celui des dessins mais nettement inférieur à celui des peintures à l'huile ou à la détrempe; qu'il convient, par conséquent, de classer les tableaux réalisés à l'aide de couleur à l'eau, de gouache et de pastel dans une nouvelle catégorie distincte, avec un seuil de 30 000 écus qui garantirait que les oeuvres d'une grande importance auraient besoin d'une licence d'exportation sans que les autorités chargées de délivrer les licences ne doivent faire face à un volume de travail administratif excessif,

The issues debated by that committee include, in particular, the interpretation of categories A3 and A4 of the Annex concerning respectively pictures and paintings executed entirely by hand and mosaics and drawings by comparison with water-colour, gouache and pastel pictures which, depending on the different artistic traditions and different price levels, were considered either as paintings or as drawings.
Parmi les questions qui ont fait l'objet d'un examen par ledit Comité, il convient de mentionner notamment celle de l'interprétation des catégories A3 et A4 de l'annexe, relatives aux tableaux et peintures faits entièrement à la main et aux mosaïques et dessins, respectivement, par rapport aux tableaux réalisés à base de couleur à l'eau (aquarelles), de gouache et de pastel, lesquels, compte tenu des différentes traditions artistiques et des différents prix pratiqués, étaient considérés soit comme des peintures, soit comme des dessins.
