With regard to the fourth plea, alleging breach of the rights of the defence, the General Court stated, at paragraph 36 of the judgment under appeal, that it was common ground that the Council adopted the contested decision without first informing the applicant of the new information or new material in the file which, in its view, justified continuing to include it in the list referred to in Article 2(3) of Regulation No 2580/2001, namely, that relating to the judicial inquiry opened in April 2001 by the anti-terrorist prosecutor’s office of the Tribunal de grande instance of Paris and to the two supplementary charges brought in March and November 2007.
S’agissant du quatrième moyen, tiré d’une violation des droits de la défense, le Tribunal a relevé, au point 36 de l’arrêt attaqué, qu’il était constant que le Conseil a adopté la décision litigieuse sans avoir préalablement communiqué à la PMOI les nouvelles informations ou les nouveaux éléments de dossier qui, selon lui, justifiaient son maintien dans la liste visée à l’article 2, paragraphe 3, du règlement n° 2580/2001, à savoir ceux relatifs à l’information judiciaire ouverte par le parquet antiterroriste du tribunal de grande instance de Paris en avril 2001 et aux deux réquisitoires supplétifs des mois de mars et de novembre 2007.

Following the judgment of the Court of Justice of the European Communities of 3 September 2008 in Joined Cases C-402/05 P and C-415/05 P: Judgment of the Court (Grand Chamber) of 3 September 2008 — Yassin Abdullah Kadi, Al Barakaat International Foundation v Council of the European Union, Commission of the European Communities, United Kingdom of Great Britain and Northern Ireland, Regulation (EC) No 881/2002 should be amended to provide for a listing procedure ensuring that the fundamental rights of the defence and in particular the right to be heard are respected.
À la suite de l’arrêt rendu le 3 septembre 2008 par la Cour de justice des Communautés européennes dans les affaires jointes C-402/05 P et C-415/05 P: arrêt de la Cour (grande chambre) du 3 septembre 2008 - Yassin Abdullah Kadi et Al Barakaat International Foundation/Conseil de l’Union européen, Commission des Communautés européennes et Royaume-Uni de Grande-Bretagne et d’Irlande du Nord, le règlement (CE) no 881/2002 devrait être modifié afin d’instituer une procédure d’inscription sur la liste garantissant que les droits fondamentaux de la défense et en particulier celui d’être entendu sont respectés.

Pursuant to Article 15(3) of the Directive of the European Parliament and of the Council on the retention of data generated or processed in connection with the provision of publicly available electronic communications services or of public communications networks and amending Directive 2002/58/EC, the Government of the Grand Duchy of Luxembourg declares that it intends to make use of Article 15(3) of the Directive in order to have the option of postponing application of the Directive to the retention of communications data relating to Internet access, Internet telephony and Internet e-mail.
Conformément à l'article 15, paragraphe 3, de la directive du Parlement européen et du Conseil sur la conservation de données générées ou traitées dans le cadre de la fourniture de services de communications électroniques accessibles au public ou de réseaux publics de communications, et modifiant la directive 2002/58/CE, le gouvernement du Grand-Duché de Luxembourg déclare qu'il entend recourir audit article 15, paragraphe 3, de la directive afin d'avoir la possibilité de différer l'application de cette directive en ce qui concerne la conservation de données de communication concernant l'accès à l'internet, la téléphonie par l'internet et le courrier électronique par l'internet.

Without prejudice to the application of Article 216 of the Treaty establishing the European Community, Article 77 of the Treaty establishing the European Coal and Steel Community, Article 189 of the Treaty establishing the European Atomic Energy Community and the second paragraph of Article 1 of the Protocol on the Statute of the European Investment Bank, the representatives of the Governments of the Member States shall adopt by common accord the necessary provisions for the purpose of dealing with certain problems particular to the Grand Duchy of Luxembourg which arise from the creation of a Single Council and a Single Commission of the European Communities.
7. Sans préjudice de l'application de l'article 216 du traité instituant la Communauté européenne, de l'article 77 du traité instituant la Communauté européenne du charbon et de l'acier, de l'article 189 du traité instituant la Communauté européenne de l'énergie atomique et de l'article 1er, deuxième alinéa, du protocole sur les statuts de la Banque européenne d'investissement, les représentants des gouvernements des États membres arrêtent d'un commun accord les dispositions nécessaires en vue de régler certains problèmes particuliers au Grand-Duché de Luxembourg et qui résultent de la création d'un Conseil unique et d'une Commission unique des Communautés européennes.
