In their letter of 20 January 2017, the French authorities specified that the refunds referred to in the second and third indents of recital 16 have been placed under a de minimis scheme pursuant to the provisions of Commission Regulation (EU) No 1408/2013 , since at the time they were granted under the conditions laid down in that Regulation, which is retroactively applicable.
