In today’s judgment, the Court notes first of all that, in order to be capable of constituting a trade mark, the subject-matter of the application for registration must, in accordance with the trade marks directive, satisfy three conditions, namely, that it must (1) constitute a sign, (2) be capable of graphic representation and (3) be capable of distinguishing the ‘goods’ or ‘services’ of one undertaking from those of other undertakings.
Par son arrêt rendu ce jour, la Cour rappelle tout d’abord que pour être susceptible de constituer une marque, l’objet de la demande d’enregistrement doit, en vertu de la directive sur les marques , remplir trois conditions, à savoir qu’il doit (1) constituer un signe, (2) être susceptible d’une représentation graphique et (3) être propre à distinguer les « produits » ou les « services » d’une entreprise de ceux d’autres entreprises.

A sign should be permitted to be represented in the Register of European Union trade marks in any appropriate form, and thus not necessarily by graphic means, as long as the sign is capable of being represented in a manner which is clear, precise, self-contained, easily accessible, durable and objective.
