K. whereas Charles Flanagan, Irish Minister for Foreign Affairs and Trade, has expressed disappointment following the continuous adjournment of the case of Ibrahim Halawa in Egypt; whereas Irish consular officials have attended all the hearings to date and have also paid 48 consular visits to Ibrahim Halawa, and whereas this underlines the importance which the Irish Government attaches to the case;
K. considérant que Charles Flanagan, ministre irlandais des affaires étrangères et du commerce, a fait part de sa déception à la suite de l'ajournement répété du procès d'Ibrahim Halawa en Égypte; que des fonctionnaires consulaires irlandais ont assisté à toutes les audiences tenues à ce jour et ont également rendu 48 visites consulaires à Ibrahim Halawa, ce qui souligne l'importance qu'accorde le gouvernement irlandais à cette affaire;

C. whereas the prosecutor has failed to provide evidence that Ibrahim Halawa was involved in a single act of violence during the protests; whereas the prosecutor has depended entirely on police witnesses and reports, and investigations by intelligence services; whereas his trial has been repeatedly postponed and adjourned by the Egyptian Court, most recently on 15 December 2015; whereas he was not charged for a year after his arrest; whereas Ibrahim Halawa is awaiting, along with 493 individuals, the majority of whom are adults, a mass trial due to take place on 19 December 2015, without any guarantee of the minimum standards for a free and fair trial being applied, and will potentially face the death penalty if convicted; whereas, in May 2015, Egypt executed six individuals, one of whom was the same age as Ibrahim Halawa is currently;
C. considérant que le procureur n'a pu fourni aucune preuve de l'implication d'Ibrahim Halawa ne serait-ce que dans un seul acte de violence commis pendant les manifestations; qu'il dépend exclusivement de témoins et d'informations provenant des rangs de la police ainsi que des enquêtes des services de renseignement; que le procès d'Ibrahim Halawa a été reporté et ajourné à plusieurs reprises par la juridiction égyptienne, en dernier lieu le 15 décembre 2015; qu'Ibrahim Halawa n'a été inculpé que plus d'un an après son arrestation; qu'il attend, ainsi que 493 autres personnes, la plupart des adultes, un procès collectif qui devrait se tenir le 19 décembre 2015, sans aucune garantie quant au respect des normes minimales relatives à un procès libre et équitable, et qu'il risque la peine de mort s'il est condamné; qu'en mai 2015, l'Égypte a exécuté six personnes, dont l'une avait le même âge qu'a actuellement Ibrahim Halawa;

9. Calls on the European External Action Service, via the EU Delegation in Cairo, and the Member States, notably Ireland, to monitor all hearings in the trial of Ibrahim Halawa and his co-defendants; expects the EEAS to raise this case at the highest level of its dialogue with Egypt and to report back regularly to Parliament on the trial monitoring; calls on the Irish authorities to continue providing their full legal, consular and other forms of support to Ibrahim Halawa and his relatives, and to visit him regularly in prison, as well as the EU Delegation; calls on the Egyptian authorities, in regard to Ibrahim Halawa’s European citizenship, to continue to facilitate consular access for the Irish Government;
9. invite le Service européen pour l'action extérieure, par l'intermédiaire de la délégation de l'Union au Caire, et les États membres, notamment l'Irlande, à suivre toutes les audiences du procès d'Ibrahim Halawa et de ses coaccusés; attend du SEAE qu'il évoque cette affaire au plus haut niveau de son dialogue avec l'Égypte et qu'il fasse régulièrement rapport au Parlement sur le suivi du procès; invite les autorités irlandaises, ainsi que la délégation de l'Union, à continuer d'apporter tout leur soutien juridique, consulaire et autre à Ibrahim Halawa et à sa famille et à lui rendre visite régulièrement en prison; invite les autorités égyptiennes, compte tenu de la citoyenneté européenne d'Ibrahim Halawa, à continuer de faciliter l'accès aux services consulaires du gouvernement irlandais;
