Whereas the harmonised patent law of the European Patent Convention is essentially limited to the phase up to the grant of the European patent, its effects are determined according to the respective national patent law of each designated Contracting State.

In accordance with the mandate adopted by the intergovernmental conference of the member states of the European Patent Organisation in Paris on 24 and 25 June 1999, two working parties were set up to carry out the preparatory work for a reform of the patent system in Europe, particularly with a view to reducing the cost and lead time involved in the granting of a patent, and for the harmonisation of litigation relating to the Community patent.

Firstly, in the complete absence of harmonisation at Community level, the European Patent Office and the various national patent offices would be free to continue their current practice of issuing patents for software-implemented inventions which may blur or even cross the line in undermining the exclusion from patentability of software as such under Article 52 of the European Patent Convention.
