Whereas, therefore, this Directive sets out essential requirements only; whereas, in order to facilitate the task of proving compliance with the essential requirements, harmonized European standards are necessary, more especially with regard to the non-electrical aspects of protection against explosions - standards relating to the design, manufacture and testing of equipment, compliance with which enables a product to be presumed to meet such essential requirements; whereas harmonized European standards are drawn up by private bodies and must retain their non-mandatory status; whereas, for this purpose, the European Committee for Standardization (CEN) and the European Committee for Electrotechnical Standardization (Cenelec) are recognized as the bodies competent to adopt harmonized standards which follow the general guidelines for cooperation between the Commission and those two bodies, signed on 13 November 1984; whereas, for the purposes of this Directive, a harmonized standard is a technical specification (European Standard or harmonization document) adopted by one or other of those bodies, or by both, at the prompting of the Commission pursuant to Council Directive 83/189/EEC of the 28 March 1983 providing for a procedure governing the provision of information on technical standards and regulations (1) and pursuant to the general guidelines referred to above;

Whereas, in order to facilitate proof of conformity with these essential requirements and to permit monitoring of that conformity, it is desirable to have Europe-wide harmonized standards in respect of the prevention of risks in connection with the design, manufacture and packaging of active implantable medical devices; whereas such standards harmonized at European level are drawn up by private-law bodies and must retain their status as non-mandatory texts; whereas, to that end, the European Committee for Standardization (CEN) and the European Committee for Electrotechnical Standardization (Cenelec) are recognized as being the competent bodies to adopt harmonized standards in accordance with the general guidelines for cooperation between the Commission and these two bodies, signed on 13 November 1984; whereas, for the purposes of this Directive, a harmonized standard is a technical specification (European standard or harmonization document) adopted by either or both of these bodies, as instructed by the Commission pursuant to the provisions of Council Directive 83/189/EEC of 28 March 1983 laying down a procedure for the provision of information in the field of technical standards and regulations (4), as last amended by Directive 88/182/EEC (5), and under the abovementioned general guidelines;

Whereas these essential requirements provide the basis for the preparation of harmonized standards at European level for construction products; whereas, in order to achieve the greatest possible advantage for a single internal market,to afford access to that market for as many mannifacturers as possible, to ensure the greatest possible degree of market transparency and to create the conditions for a harmonized system of general rules in the construction industry, harmonized standards should be established as far as, and as quickly as, possible; whereas these standards are drawn up by private bodies and must remain non-mandatory texts; whereas, for that purpose, the European Committee for Standardization (CEN) and the European Committee for Electrotechnical Standardization (Cenelec) are recognized as the competent bodies for the adoption of harmonized standards in accordance with the general guidelines for cooperation between the Commission and those two bodies signed on 13 November 1984; whereas, for the purposes of this Directive, a harmonized standard is a technical specification (European standard or harmonized document) adopted by one or both of those bodies upon a mandate given by the Commission in accordance with the provisions of Council Directive 83/189/EEC of 28 March 1983 laying down a procedure for the provision of information in the field of technical standards and regulations (5);

Three areas received particular attention at the European Council: (a) taxation * The European Council was concerned at the delay in finding a solution to the problem of the taxation of savings and stressed the need to ensure that the liberalization of capital movements did not facilitate tax fraud. It asked the Council to find a solution so that agreement could be reached before 1 July 1990; * The European Council emphasized the need to reach agreement, before the end of the year, on the broad lines of a solution to the harmonization of indirect taxation (b) The free movement of persons: the European Council endorsed the conclusions of the Coordinators's Group report (the "Palma Document") on the measures needed in different fields and instructed the Group to spare no effort to ensure that the programme of work proposed in the Palma Document was completed as planned. c) Audiovisual field: the Council requested that the Directive on which a common position had been reached in April 1989 should be adopted within the period laid down under the cooperation procedure.
Trois domaines particuliers font l'objet d'une attention plus grande du Conseil européen. a) La fiscalité - inquiet du retard constaté dans la recherche d'une solution au problème de la fiscalité sur l'épargne, il souligne la nécessité de faire en sorte que la libération des mouvements de capitaux ne facilite pas les fraudes fiscales et demande au Conseil de trouver une solution afin d'arriver à un accord avant le 01/07/1990. - pour le rapprochement des fiscalités indirectes, il souligne la nécessité de parvenir avant la fin de l'année à un accord sur les grandes lignes d'une solution dans ce domaine. b) La libre circulation des personnes Le Conseil européen fait siennes les conclusions du rapport des coordonnateurs ("document de Palma de Majorque") sur les mesures à prendre dans les différents domaines et donne mandat au groupe de tout mettre en oeuvre pour que le programme de travail proposé dans le Document soit réalisé comme prévu. - 4 - c) L'audiovisuel Le Conseil demande l'adoption de la directive qui a fait l'objet d'une position commune en avril 1989 dans les délais prévus par la procédure de coopération.

At the close of its discussions the Council adopted the following conclusions: "THE COUNCIL - REITERATES that in its Resolution of 7 February 1994 it invited the Commission to propose, before 1 July 1994, the measures necessary for the realization of the objectives identified, with a view to implementing without delay a Community policy on postal services, and in particular measures relating to universal service, services which can be reserved, and standardization; - NOTES that on 26 July 1995 the Commission accordingly adopted an overall approach consisting of the abovementioned draft Notice and a proposal for a Directive based on Article 100a, providing for a harmonized framework for the postal sector; - EMPHASIZES that the relevant Council bodies began the technical discussions without delay and that today the Council had an initial policy debate on the proposal for a Directive and a debate on the draft Notice; - AGREES to continue active discussion of the proposal for a Directive in order to arrive at an agreed common position under the auspices of the Italian Presidency; - OBSERVES that the Notice envisaged by the Commission is not in itself binding but is a document in which it announces the guidelines it intends to follow in applying the Treaty's competition rules to the postal sector; - REQUESTS the Commission, in any follow-up to its draft Notice, to take the utmost account of the Council's comments, especially on the need to ensure, for the sake of transparency and legal certainty, that: - the definitions and concepts used in the Notice, in the proposal for a Directive or in other relevant Community provisions are consistent with one another; - the notice is published in the Official Journal at the same time as the Directive and in any case before the end of 1996; - EMPHASIZES that these conclusions are without prejudice to the positions of the Member States on the form and content of the Commission Notice".
A l'issue de ses délibérations, le Conseil a adopté les conclusions suivantes : "Le CONSEIL, - RAPPELLE que, dans sa résolution du 7 février 1994, il avait invité la Commission à proposer avant le 1er juillet 1994 les mesures nécessaires à la réalisation des objectifs identifiés pour mettre en oeuvre rapidement une politique communautaire des services postaux, et notamment des mesures relatives au service universel, aux services réservables et à la normalisation; - PREND NOTE de ce que la Commission a adopté en ce sens, en date du 26 juillet 1995, une approche globale comportant le projet de communication précité ainsi qu'une proposition de directive, basée sur l'article 100 A, prévoyant un cadre harmonisé pour le secteur postal ; - SOULIGNE que les travaux techniques ont été engagés sans délai par les instances compétentes du Conseil et que ce dernier a procédé ce jour à un premier débat d'orientation sur la proposition de directive et à un débat sur le projet de communication ; - CONVIENT de poursuivre activement ses travaux sur la proposition de directive afin de parvenir rapidement à un accord sur une position commune sous les auspices de la Présidence italienne ; - NOTE que la communication envisagée par la Commission ne revêt pas en elle-même un caractère contraignant mais constitue un document par lequel celle-ci fait connaître les lignes directrices qu'elle entend suivre dans l'application au secteur de la poste des règles de concurrence du traité; - DEMANDE à cet égard à la Commission, dans la mesure où elle entendrait donner suite à son projet de communication, de tenir le plus grand compte des observations du Conseil en particulier de la nécessité de veiller, dans un souci de transparence et de sécurité juridique, - à ce que les définitions et les concepts utilisés respectivement dans la communication et dans la proposition de directive ou dans d'autres dispositions communautaires pertinentes soient cohérents ; - à ce que la publication de la commun ...
