Welcomes the fact that after the former Head of the Legal Service left the Agency in June 2012 to join a US-based law firm having a number of pharmaceutical industry companies as clients as senior counsel, the Executive Director of the Agency launched a review of his work as Head of the Legal Service, Chair of the Joint Committee, Chair of the Disciplinary Committee and as a member of the Advisory Committee on Procurement and Contracts; acknowledges that no evidence of conflicts of interest nor breach of obligations provided in Articles 11 and 11a of the Staff Regulations could be identified; welcomes the fact that in accordance with Article 16 of the Staff Regulations, the Executive Director imposed some restrictions to the activities of the former Head of Legal Service for a period of two years following his leaving the Agency; calls on the Agency to provide the discharge authority with detailed information on those restrictions;

In order to enable them to assess whether the purpose of the international service is to carry passengers on a route between stations located in different Member States, and what the potential economic impact on existing public service contracts is, regulatory bodies shall ensure that any competent authority that has awarded a rail passenger service on that route defined in a public service contract, any other interested competent authority with a right to limit access under Article 11 and any railway undertaking performing the public service contract on the route of that international passenger service is informed.
Afin de pouvoir évaluer si l'objectif d'un service international est le transport de voyageurs sur un trajet entre des gares situées dans des États membres différents et quelle est l'incidence économique potentielle sur les contrats de service public existants, les organismes de contrôle veillent à ce que toute autorité compétente ayant attribué un service ferroviaire de transport de voyageurs sur ce trajet défini dans un contrat de service public, toute autre autorité compétente concernée ayant le droit de limiter l'accès en vertu de l'article 11 et toute entreprise ferroviaire exécutant le contrat de service public sur le trajet de ce service international de transport de voyageurs soient informées.

Expresses its satisfaction that, since 1 October 2007, two separate administrative units (an internal audit unit and a verification unit) have been put in place with two separate heads of unit, ending a situation criticised in previous years by both the ECA and Parliament where the head of the Internal Audit Service was responsible for ex-ante verification of the authorising officers' operations;
7. se félicite de l'instauration, le 1 octobre 2007, de deux unités administratives distinctes (une unité d'audit interne et une unité de vérification) dirigées par deux chefs d'unité différents, qui a mis fin à une situation, dénoncée au cours des années précédentes tant par la Cour des comptes que par le Parlement, dans laquelle le responsable du service d'audit interne était chargé de la vérification ex ante des opérations effectuées par les ordonnateurs;

In order to enable the assessment of the purpose of the international service to carry passengers between stations located in different Member States, and the potential economic impact on existing public service contracts, regulatory bodies shall ensure that any competent authority that has awarded a rail passenger service defined in a public service contract, any other interested competent authority with a right to limit access under Article 10(3b) of Directive 91/440/EEC and any railway undertaking performing the public service contract on the route of this international passenger service is informed’.

The Office can also share with the Commission's Internal Audit Service and the internal audit unit in the relevant Directorate-General or department all the information relating to systemic defects in internal audit arrangements that it identifies with a view to routine follow-up.
