In the case at hand, the type of competition which is most interesting for consumers — price competition with regard to the level of contributions — is ruled out since Slovak health insurers cannot modify the level of contributions of the insured which are fixed by law.

While no restrictions will be introduced at the EU level on substances posing low health, social and safety risks, substances posing moderate risks will be subjected to consumer market restriction, which means that they cannot be sold to consumers (except for uses specifically authorised, for instance by medicines legislation) but their trade is allowed for commercial and industrial purposes as well as for scientific research and development.

Exemptions apply for rapidly perishable goods, sealed goods opened by the consumer which cannot be returned for health or hygiene reasons, and hotel reservations or car rentals which are tied to specific dates.

(32) Since the objective of this Regulation, namely to ensure the functioning of the internal market as regards products intended for consumers while guaranteeing a high level of health and safety protection of consumers, cannot be sufficiently achieved by the Member States and can therefore, by reason of the scale of the measure, be better achieved at Union level, the Union may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty on European Union.
(32) Étant donné que les États membres ne peuvent atteindre de manière suffisante l’objectif du présent règlement, à savoir protéger le fonctionnement du marché intérieur des produits destinés aux consommateurs tout en garantissant aux consommateurs un niveau élevé de sécurité et de protection de la santé, et que, par son ampleur, cet objectif peut être mieux réalisé par l’Union, celle-ci peut prendre des mesures conformément au principe de subsidiarité consacré à l’article 5 du traité sur l’Union européenne.

Should the first question be answered in the negative: Is Article 27(1)(f) of Regulation (EC) No 889/2008 to be understood as meaning that the use of the substances referred to is also legally required where the marketing of a foodstuff as a food supplement or bearing health claims would, without the addition of at least one of the substances referred to, tend to mislead the consumer because the foodstuff cannot, in the absence of one of the substances referred to in sufficient strength, fulfil its stated purpose as a foodstuff or its stated purpose as expressed by the health claim?

A notification on a product that cannot be indisputably classified as a consumer product, which however provides information on a new type of risk to the health and safety of consumers, is an example of a notification that can be distributed through the RAPEX application as a ‘Notification for information’.
